According to Appiah Stadium, “There is no difference between a hawker doing a business at Makola market and NDC 137 MPs in parliament. A private legal practitioner and member of the National Democratic Congress (NDC), Nii Kpakpo Samoa Addo believes the party’s legal team failed to do due diligence before closing its case in the election petition. “One of the ways of eliciting evidence was through the Chairperson. You must get your opponent in the box. In this particular instance, the NDC legal team took a gamble. They failed to get the EC or any official of the EC to be subpoenaed before they close the case,” Nii Kpakpo Samoa said on Citi TV/FM’s The Big Issue. John Mahama’s counsel had closed its case in the petition but was compelled to reverse its decision after the EC’s lawyers decided to also close its case thus keeping the EC Chair, Jean Mensa from testifying in the case. Mr. Mahama’s lawyers objected to the application but the court later ruled that it cannot compel Ms. Mensa to take the witness box. Mr. Addo said the party should have withdrawn its petition after the EC Chairperson failed to mount the witness box. “Once the EC did not mount the box, the petition should have been withdrawn. The court case died the day the application to reopen the case to enable the petitioner to issue a subpoena to the EC failed.” About the election petition Flagbearer of the NDC in the 2020 election, John Mahama is in court after he and his party rejected the results of the presidential polls. Mr. Mahama is of the view that President Nana Addo Dankwa Akufo-Addo failed to obtain the requisite number of votes to be declared the winner. He is thus asking the Supreme Court to among other things declare the 2020 presidential polls null and void and further ordered the EC to conduct a re-run of the election between himself and President Akufo-Addo. But in their closing Address, President Akufo-Addo’s lawyers said Mr. Mahama did not properly invoke the jurisdiction of the Court on election matters, and at the same time, failed to sufficiently discharge the burden of proof upon him as the petitioner. The EC also shot down assertions being made by Mr. Mahama saying the 2020 polls were the most credible since the inception of the 4th Republican Constitution. The Commission denied that the December 9 declaration was invalid and urged the Court not to grant Mr. Mahama’s reliefs. But according to the review application, Mr. Mahama insisted that the apex court made fundamental errors in its ruling. He is thus praying the court to reconsider his new argument and depart from its earlier ruling. “I am advised by counsel and verily believe the court made fundamental errors of law including the ruling being per incuriam of constitutional provisions, statutes and previous decisions of the Supreme Court.” “Among these errors, I am advised by counsel and verily believe is an error whereby the courts subordinates a provision in the Evidence Act to a rule in subsidiary legislation by the Rules of Court Committee,” the application added. The Supreme Court in a unanimous decision within the week dismissed the application filed by the petitioner, seeking a review of an earlier ruling affirming the right of the Chairperson of the EC, Jean Mensa not to testify in the ongoing case. In that ruling, the court also said the petitioner didn’t convince the bench to depart from its earlier ruling. “The applicant has failed to satisfy the court that a new or important matter resulted from the reference to the constitutional provisions referred to [in the earlier ruling].” “In the result, the application fails, and it is hereby dismissed,” the Chief Justice read on behalf of the panel of justices. A Wenchi High Court in the Bono Region presided over by Fred Nawura has dismissed an application for Injunction of the swearing-in of the Member of Parliament(MP)-elect for the Techiman South Constituency. The National Democratic Congress (NDC) has said that it won the Techiman South Parliamentary election but the Electoral Commission and the NPP connived to rid them of the success chalked in the election. The largest opposition has allegedly provided evidence to back its claims that the party’s candidate Christopher Bayere Baasongti won the seat from the NPP. However, the Electoral Commission insists that the NDC never won the seat like they are making some sections of Ghanaians believe. The National Council of the governing New Patriotic Party (NPP) is meeting to approve or disapprove proposals made by the party’s Steering Committee for leadership positions in Parliament. The Steering Committee on Thursday, December 31, 2020, proposed that Osei Kyei-Mensah-Bonsu be retained as Majority Leader of Parliament, whilst Alexander Afenyo Markin be made the Deputy Majority Leader. The Chief Whip slot which is currently held by Kwasi Ameyaw-Cheremeh, the Sunyani East MP has been earmarked for Frank Annoh Dompreh, the Nsawam-Adoagyiri MP. Mr. Dompreh’s deputies will be the Tolon MP, Habib Iddrisu, and the Mfantsiman MP, Ophelia Hayford after Matthew Nyindam, the Kpandai MP, and Moses Anim, the Trobu MP held those positions in the current Parliament. The meeting which has the President, the Vice President and Chief of Staff in attendance will also approve the nomination of either Freddie Blay or Professor Michael Oquaye as Speaker of the House. Unlike in 2016 where the NPP secured a record majority with 169 seats in Parliament, the governing party’s representation dropped to 137 seats in Parliament. The NDC matched the NPP by also winning 137 seats in Parliament, the highest ever proportion of seats held by an opposition party in Ghana’s Fourth Republic. The two parties were joined by an independent candidate, Andrew Amoako Asiamah, who won the Fomena seat. President-elect Nana Addo Dankwa Akufo-Addo will next Thursday, January 7, 2020 be sworn-in as President for a second term in a parliamentary tent created at the Parliament House, in Accra. He will, however, deliver the State of the Nation Address, in the chamber of parliament, in Osu-Accra, tomorrow, Tuesday, January 5, 2021. Mr Osei Kyei-Mensah-Bonsu, the Majority Leader in Parliament, announced the venues on Monday, in Accra, when House returned for the Christmas and New Year holidays, to complete the last three days of the Seventh Parliament of the Fourth Republic. He said the election of the new Speaker of Parliament would take place in the chamber, but the swearing-in of the new parliament, the Eighth Parliament of the Fourth Republic would take place in the tent. The announcement was in response to Members’ questions on the exact venues within the precincts of House, for the President and President Elect’s constitutional roles in relation to the delivery of the State of the Nation’s Address (SONA) and his inauguration. The Seventh Parliament, which began on January 7, 2017, would dissolve on the night of January 6, 20202, and usher in the Eighth Parliament of the Fourth Republic, on the eve of January 7, 2021. Mr Kyei- Mensah-Bonsu, announced in the Business Statement that “H E the President of the Republic is expected to deliver a Message on the State of the Nation prior to the dissolution of the Seventh Parliament, on Tuesday, 5th January 2021, in accordance with Article 67 of the Constitution.” He entreated members to attend upon the House punctually for the event. A visit of the Ghana News Agency (GNA) to the car park of the Parliament House, where a large conference tent has been erected for the ceremony, shows that finishing touches were being done to the place for the ceremony. The hitherto open space has been tarred with goudron, and the avenue trees to the venue have been re-painted fresh from the base to the stem in the Ghana national colours of red, yellow and green. The street has also seen much improvement. The dwarf poles holding the street lights the venue, which were in disrepair and had looked abandoned, were being worked on, with numerous barricades under the giant mahogany trees that line the streets. The inauguration ceremony at the Parliament House follows a decision to move the inauguration from the Black Star Square after an appeal by Parliament last November to have subsequent swearing-in of presidents in the precincts of parliament. The GNA observed a heightened security presence in the precincts. Meanwhile, Minority Chief Whip Alhaji Mubarak Muntaka, in contribution to the Business Statement, has prayed the Leadership of the House not to engage members in any tall business before dissolution to allow for ample time for the business of the Committee on Emoluments. We’ll not honour police summons to appear in court on Monday – Minority MP

National Democratic Congress (NDC) MP for Kunbungu, Ras Mubarak, says his minority colleagues will not honour a police summon served on them to appear before the Accra Magistrate Court on Monday. The police have charged 20 NDC MPs including Minority Leader Haruna Iddrisu with two offences against the state for walking to the headquarters of the Electoral Commission on 22nd December 2020 to present a petition. Clad in red and black, the MPs walked from parliament house, broke through a police barricade at the Ridge Roundabout and marched to the EC headquarters with the petition. The petition demanded a collation of the 2020 Techiman South parliamentary elections results. The police in a statement of offence accused the minority MPs of failing to notify the police before holding a special event contrary to sections 1, 2 and 9 of the Public Order Act. The police have also charged them with unlawful assembly contrary to section 202 of the Criminal Offences Act. The statement of offence claims the MPs did unlawfully assemble with a common purpose and conducted themselves in a manner likely to cause persons in the Ridge neighbourhood reasonable fear. It also accuses them of acting in a manner likely to cause a breach of peace. “You are hereby commanded in the name of the republic to appear before this court at Accra on the 4th of January 2021,” the summons distributed in the pigeonholes (shelves) of each of the 20 MPs read. The MPs affected by the summons include Deputy Minority Leader James Klutse Avedzi, Minority Chief Whip Muntaka Mubarak, Ningo Prampram MP Samuel George, former Deputy Interior Minister James Agalga, John Jinapor, Rockson Dafiamekpor, Adam Mutawakilu, Ebenezer Terlabi, Dr. Kwabena Donkor, A. B. A. Fuseini, Kofi Buah, Rashid Pelpuo and Richard Quarshigah. The rest are Collins Dauda, Yussif Jahja, Kwabena Mintah Akandoh, and Kunbungu MP Ras Mubarack. NDC Deputy General Secretary Peter Otukunor is the other individual charged in connection with the alleged offences. Ras Mubarak tells Joy News the police is committing an illegality by executing a criminal summons on serving members of parliament without the permission of the speaker. Article 117 of the 1992 Constitution states that “civil or criminal process coming from any court or place out of Parliament shall not be served on, or executed in relation to, the Speaker or a member or the clerk to Parliament while he is on his way to, attending at or returning from, any proceedings of Parliament.” “In any case, parliament is sitting tomorrow (Monday) at 10am. And they of all people should know better that when parliament is sitting, unless the speaker explicitly releases any MP, no one can summon them to any court. So, this is an illegality,” Mr. Mubarak said. “They should follow the Constitution. They should contact the speaker to inform him of what they want to do, the speaker will give directions, invite the parties, and discuss it before any such service can be served on MPs. “But you don’t send these things to MPs and leak it to the media and expect that any MP will take you seriously. They are taking us into the abyss,” he told Joy News. The Kunbungu MPs says he and his colleagues will not be in court tomorrow. “Personally, I will not be in court. Because the proper thing has not been done. I get the indication that is the position of my colleagues too. “I have not seen any letter from the speaker’s office permitting them to serve me as an MP,” he explained.
