Muntaka Mubarak, the Chief Whip for the Minority in Parliament has reminded Sammy Gyamfi, the National Communications Officer of the National Democratic Congress that national interest must always take precedence over that of the party’s. “I don’t want to go into the merit or demerit of the party interest. If we don’t take care party politics will overrun our own values and constitution and our national interest,” Muntaka told Adom FM. This is after Sammy Gyamfi accused him and the leadership of the minority of advancing their parochial interest at the expense of the party’s. “Some have sold their conscience but ours is intact. And we can work together to rebuild the party from the ashes of 3 March 2021, which I call ‘Black Wednesday’ – our day of self-inflicted shame,” Mr Gyamfi said in the post, adding: “This is the time for us to insist on the right changes in the leadership of the NDC group in parliament or forget about them completely.” “The current leadership have lost their moral authority to lead and are not fit to sit on the front bench of the NDC side of the house. More importantly,” he noted, “it’s about time we understood that we don’t have any NDC Speaker of Parliament”. “No, we don’t!” he stressed, in reference to Mr Bagbin, complaining: “We have a Speaker who rode on the back of the NDC into office to pursue his own parochial agenda and nothing more. You trust them at your own peril,” he warned members and supporters of the NDC. But Muntaka says the priority of parliamentarians is to do the bidding of their constituents which encompasses members of all the political parties and not just the NDC. He says that in the institution of parliament, the demands of a particular party are treated as a piece of advice and when it clashes with the national interest, it is imperative that MPs place the country over their party. He reminds Sammy Gyamfi again that when he took the oath of office, it was a pledge to uphold the constitution of the country and not the constitution of the NDC. “Every member of parliament swore an oath to uphold the constitution. The mandate of every member of parliament overruns his party. The mandate of every member of parliament is above the interest of the party because after the election you don’t only represent the party but everyone in your constituency. Your party is just one leg so anything from your party is just an advice. You should remember that the buck stops with you the MP.” “You swore an oath to your own conscience and values. Speaker Alban Bagbin has told Class Media Group’s Accra100.5FM, Class91.3FM and CTV in an interaction scheduled for simultaneous airing on Monday, March 15, 2021 on all three channels that he does not belong to any political party now that he occupies the position of the third-most powerful person in Ghana. The longest-serving legislator in Ghana’s political history, after a rancorous Speakership poll, ascended the position a little over two months ago despite his party, the main opposition National Democratic Congress (NDC) having lost the December 7, 2020 presidential election and splitting the 275 seats of Parliament with the governing New Patriotic Party (NPP). The former Nadowli-Kaleo MP, who had been a lawmaker since the almost-three-decade-old fourth republic of Ghana, recently came under attack, along with Minority Leader Haruna Iddrisu and Minority Whip Muntaka Muburak, from the National Communications Officer of the NDC, Mr Sammy Gyamfi, after the house passed some contentious ministerial nominees of President Nana Akufo-Addo despite express directives from the Functional Executive Committee of the party, that those ministers-designate be rejected for various reasons. Mahama not being given fair hearing – Sammy Gyamfi
National Communications Officer of the National Democratic Congress (NDC) Sammy Gyamfi has said that the petitioner in the ongoing election petition hearing, Mr John Mahama is not being given a fair hearing by the court. Addressing the media after court proceedings on Monday February 22, Mr Gyamfi said “The bottom line is that the petitioner is worried that the court, in deciding these applications are not applying statutes that had been passed by our parliament, statutes that the court has been applying in other cases and we think that the petitioner is being denied a fair hearing and it is important to pursue these issues to the logical conclusions.” During proceedings on Monday, the Supreme Court of Ghana by a unanimous decision dismissed a review application filed by lawyers of Mr Mahama, against the court’s earlier ruling on whether or not witnesses can be compelled to testify in the court. Chief Justice Anin Yeboah in the ruling on behalf of the nine justices said the application was without merit and accordingly dismissed it. Lead counsel of the petitioner in the ongoing election petition hearing Tsatsu Tsikata has yet again made a case for the Supreme Court to reconsider its ruling on Tuesday, February 16. The seven justices of the apex court of Ghana unanimously dismissed the application of the petitioner, John Dramani Mahama, for the case to be re-opened in order to subpoena the Chair of the Electoral Commission, Ghana (EC), the First Respondent, to testify in court as a “hostile witness”. On Monday, February 22, Mr Tsikata questioned the basis of the ruling, saying the justices themselves were surprised when the First Respondent closed its case without calling its witness, Jean Adukwei Mensah, to testify. Mr Tsikata said the justices may have their reasons for the decision to dismiss the application but “it is the ruling of the panel that we are here to question”. “I am not in the minds of the panel,” he stressed. He further argued that for Mrs Mensa to have filed a witness statement meant that she was committed to mount the witness box. “We have no reason to say she was not telling the truth,” he said. Even Akufo-Addo won’t disrespect Tsatsu like Oppong Nkrumah, Nana B do – Gyamfi
The legal team of former President John Mahama has described as “disrespectful”, some of the post-trial commentary of fellow lawyers Kojo Oppong Nkrumah and Henry Nana Boakye (Nana B) of President Nana Akufo-Addo’s side, against Mr Tsatsu Tsikata, the lead counsel for the petitioner in the ongoing election petition at the Supreme Court. “The disrespect from the spokespersons of the 2nd Respondent toward the lawyer for the petitioner in the course of these proceedings for us is very unacceptable”, Mr Sammy Gyamfi told journalists on Thursday, 18 February 2021 after the court adjourned sitting. “You hear them stand here and describe things that counsel for the petitioner has said as English and grammar: ‘Lawyer Tsatsu Tsikata was just speaking English and not law’,” he said. “You do not do that, we are not trained to say things like that about our seniors at the bar. All these people are juniors by far to the people they are trying to ridicule. When we [NDC] come and stand here, we do not ridicule the likes of senior Akoto Ampaw and Justine Amenuvor; we all see how they struggle on their feet, yet we do not come here to ridicule or mock anybody”, noted. “I mean why do you come and stand here and talk down on somebody that you may never be able to even come close to what they have attained or achieved in life. I am not sure that even President Akufo-Addo will disrespect lawyer Tsatu Tsikata.” Mr Gyamfi’s comments dovetail into a similar concern raised by the main opposition National Democratic Congress (NDC) in a press statement on Thursday, in which the party said Information Minister-designate Oppong Nkrumah must stop inciting the Supreme Court against former Deputy Attorney General Dr Domini Ayine. The statement, signed by Communication Director Kakra Essamuah took issue with what it describes as the constant attacks unleashed on the lawyers of the former President by the legal spokespersons of the second respondent, President Nana Akufo-Addo. How do you expect NDC collate ‘credible’ results from error-ridden pink sheets? – Sammy Gyamfi asks
National Communication Officer of the National Democratic Congress (NDC) Sammy Gyamfi has reacted to criticisms that the NDC failed to collate presidential results after the 2020 General Elections, wondering how the party could have collated any proper and true results from pink sheets and summary sheets that contain errors. “If I may ask, how can anyone expect the NDC to do any true and proper collation of results on the basis of polling station pink sheets and constituency summary results sheets that contain several patent arithmetic errors and arrive at any accurate outcome? I don’t get it!” He wrote on social media. Mr Gyamfi argued that the request for the NDC’s own results is not justified because the NDC is in the Supreme Court to challenge the declaration by the Electoral Commission and not to present its version of collated results to the Court. Read full statement below: On the matter of the demand for the NDC to present its own collated results of the 2020 Presidential Elections; For the records, candidate Akufo-Addo and Dr. Bawumia did not present their own collated figures or results to the Supreme Court in the 2012/2013 election petition. I dare anybody who disputes this fact to point me to any paragraph in the 2012 election Petition where the petitioners presented their own collated figures to the Supreme Court to show that they won the 2012 presidential election. In that case, the petitioners presented the EC’s own declared figures to the court and asked the court to annul about 4 million votes on grounds that those votes had been affected by alleged legal infractions and irregularities. The petitioners then proceeded to deduct those votes from the results/figures declared by the EC and sought a declaration from the court that candidate Akufo-Addo won the 2012 Presidential election on the basis of the resultant outcome, i.e if those votes were actually annulled. The Petitioners did not present their own collated figures to the Supreme Court to show that they won that election. Unlike the Petitioners in the 2012/2013 case (Akufo-Addo & Bawumia), the petitioner in the present case, John Mahama is not asking the Supreme Court to annul votes and declare him President-elect on the basis of the resultant outcome. He is simply telling the court that per the figures contained in the declaration of the Chairperson of the EC and Returning Officer of the 2020 Presidential elections, Mrs. Jean Adukwei Mensah, none of the 12 candidates in the 2020 Presidential elections attained more than 50% of the total valid votes cast as required by article 63(3) of the 1992 constitution, hence the declaration of candidate Akufo-Addo as President-elect is unconstitutional. Therefore to my mind, John Mahama doesn’t need his own collated figures to illustrate or prove his claim that Jean Mensah’s declaration is unconstitutional and invalid. Rather, he needs the figures contained in the declaration of Jean Mensah to illustrate and prove his case, which is precisely what he is doing in court. Why then is he being asked to present his own collated figures to the Supreme Court, before he can challenge the constitutionality/validity of the 2020 Presidential results declared by Jean Mensah as per Jean Mensah’s own figures? Particularly, when his own collated figures has got nothing to do with his petition, which is only a challenge of the constitutionality/validity of the Presidential results declared by Jean Mensah on the basis of figures contained in same. Why NDC did not present its collated figures to Supreme Court – Sammy Gyamfi reveals
Lawyer Sammy Gyamfi, a member of the National Democratic communication team in the ongoing election petition has stated that the case presented to the Supreme Court by his party’s flagbearer in the 2020 presidential election, does not require the presentation of their collated results for their case to be proven. John Dramani Mahama who is the petitioner in the case is asking the supreme court to cause a rerun of the 2020 presidential election between himself and President Nana Addo Dankwa Akufo-Addo (second respondent) on the basis that the Electoral Commissioner, Madam Jean Mensah (Second respondent) per the figures which she declared as the result had none of the 12 candidates obtaining more than 50% of the total valid votes as required by the constitution. In a back-and-forth banter with members of the bench in the ongoing petition, the General Secretary of the NDC, Johnson Asiedu Nketia who is a witness for the petitioner during cross examination said he was unable to furnish the court with votes obtained by his party’s candidate in the election based on their collated results. His answer to the supreme court judges has many critics highlighting it as a moment of damage to the NDC’s case. However, Sammy Gyamfi who doubles as the party’s National Communications Director in a Facebook post has explained why the party’s collated results, is not significant in arguing their case. Drawing on the similarities and differences between the NDCs 2020 petition and New Patriotic Party’s 2012 petition, Sammy Gyamfi points that Nana Addo Dankwa Akufo-Addo in 2012 did not present his own collated results to support his case despite asking the court to annul portions of the total valid votes and declare him winner of the presidential election based on the resultant outcome. “For the records, candidate Akufo-Addo and Dr. Bawumia did not present their own collated figures or results to the Supreme Court in the 2012/2013 election petition. I dare anybody who disputes this fact to point me to any paragraph in the 2012 election Petition where the petitioners presented their own collated figures to the Supreme Court to show that they won the 2012 presidential election. In that case, the petitioners presented the EC’s own declared figures to the court and asked the court to annul about 4 million votes on grounds that those votes had been affected by alleged legal infractions and irregularities. The petitioners then proceeded to deduct those votes from the results/figures declared by the EC and sought a declaration from the court that candidate Akufo-Addo won the 2012 Presidential election on the basis of the resultant outcome, i.e if those votes were actually annulled. The Petitioners did not present their own collated figures to the Supreme Court to show that they won that election,” he explained. Again, he averred that “unlike the Petitioners in the 2012/2013 case (Akufo-Addo & Bawumia), the petitioner in the present case, John Mahama is not asking the Supreme Court to annul votes and declare him President-elect on the basis of the resultant outcome. He is simply telling the court that per the figures contained in the declaration of the Chairperson of the EC and Returning Officer of the 2020 Presidential elections, Mr. Jean Adukwei Mensah, none of the 12 candidates in the 2020 Presidential elections attained more than 50% of the total valid votes cast as required by article 63(3) of the 1992 constitution, hence the declaration of candidate Akufo-Addo as President-elect is unconstitutional.” On this basis, NDC National Communicator says “John Mahama doesn’t need his own collated figures to illustrate or prove his claim that Jean Mensah’s declaration is unconstitutional and invalid. Rather, he needs the figures contained in the declaration of Jean Mensah to illustrate and prove his case, which is precisely what he is doing in court.” He emphasised that the collated figures of the NDC has nothing to with the petition; adding that the petition is only challenging the constitutionality and validity of the 2020 election Presidential results declared by madam Jean Mensah based on the figures contained in her declaration. Election 2020: Sammy Gyamfi presents evidence of electoral fraud
Sammy Gyamfi, the Communications Officer of the opposition National Democratic Congress has presented to the general public evidence of electoral fraud in the just-ended December 7 elections, which his party has gathered so far. He maintained that the 2020 presidential election results declared by Jean Mensa, the Electoral Commission (EC) Chairperson, is a ‘stolen verdict’ for the incumbent president, Nana Addo Dankwa Akufo-Addo, hence his party’s rejection of the declared results. Gyamfi, at a news conference at the party’s headquarters in Accra, claimed some evidence gathered by the party so far has established the point that the Jean Mensa-led EC at some polling stations decided to reduce the votes of the NDC candidate, John Dramani Mahama, and added more figures to the votes of candidate Akufo-Addo. He indicated that what the party has detected in their audit of the pink sheets is “naked thievery”. Sammy Gyamfi cited an example thus, “So Sunyani West SDA Primary School, Chiraa 1 Polling Station, the number of voters on the voter’s register is 49. Total ballots allocated to the polling station by the EC per the constituency ballot statistics document they themselves gave political parties is 60.” “Yet, the total votes cast at the polling station is 466 as recorded on the face of the pink sheet. If this is not evidence of electoral fraud, then what is it?” he questioned. “Mind you, this is just one out of the thousands of cases of over-voting we have uncovered through our painstaking audit of pink sheets,” he added. Sammy Gyamfi averred, “right from the onset, it was clear that the NPP was given an illegal advantage to cheat by the Electoral Commission. They have been given official ballot papers which were security materials, stamped with the EC’s validation stamp…” Sammy Gyamfi stressed that the NDC have “all the pink sheets and at the right time, we are going to make our findings public”. The EC within 48 hours of voting on Wednesday, December 9, declared the incumbent President, Nana Addo Dankwa Akufo-Addo, the president-elect of Ghana, but has changed its figures several times, all of which point to a run-off election, yet the EC claims its wrongful addition of figures and calculation of percentages are correct. For example, the EC on Thursday, December 10, issued a statement admitting an error saying its Chairperson, “inadvertently used 13,433,573 as the total valid votes cast”. “The total valid votes cast is 13,119,460. This does not change the percentages stated for each candidate and the declaration made by the Chairperson.” John Dramani Mahama, who led the NDC into the 2020 elections, at a press conference after the EC declared President Akufo-Addo the winner of the presidential race, described the results as ‘flawed and fictionalised.’ Mahama averred that data available to his party from across all the 16 regions of Ghana showed that he had won the 2020 presidential election, insisting that any other pronouncement by the EC was evidence of manipulation of figures.
