Hear ‘only important cases’, don’t call frivolous ones in open court; dismiss them ‘in chambers’ – AG to SC

Attorney General Godfred Dame has told the Supreme Court that it has to start dismissing, in chambers, all frivolous cases while giving attention to only important cases as part of measures to reduce the caseload. “The time has come for the Supreme Court to reduce its caseload by prioritising the kinds of cases it actually hears”, Mr Dame suggested and proposed that cases without merit not be called at all in open court but dismissed in chambers. The Minister of Justice was speaking at the opening of this year’s Bench, Bar, and Faculty Conference in Accra on Thursday. In his view, “only important cases with the potential of resulting in a change of the law or with an immense public interest, should be heard by the Supreme Court.” He proposed that the rules of the court be revised to make room for his suggestion so as to make the courts more productive and effective. Mr Dame also suggested that some innovations made to the court system as a result of the COVID-19 pandemic be made permanent features of the judicial process. “Virtual hearing of cases should become a regular feature of our court system”, he said. —Classfm

Law practice a privilege, not a right – Godfred Dame

The Attorney General and Minister for Justice, Godfred Yeboah Dame, has resurrected the debate on access to Legal Education and the law profession in the country. Speaking at the Induction Ceremony of new executives of the Ghana Bar Association (GBA), the Attorney General also bemoaned the falling standard and ethics with the legal profession in recent times. “Mr. President and new executives, you owe a duty to drive home the point that the practice of law is not a right, it is a privilege. Along with it comes a moral obligation and a legal duty to uphold the dignity of the profession to ensure that the privileged call to the bar is not abused through unprincipled and disreputable conduct. “Standards of practice have declined to their lowest depths, and I speak from experience of what I witnessed in the Supreme Court last week in the conduct of some lawyers in certain cases that they handled. Ethics is virtually thrown to the dogs in the dishonorable quest of some lawyers to win a case,” he advised. His comment comes in the wake of disagreements between the Attorney General and Parliament on the 499 students who were disallowed admission into the Ghana School of Law (GSL) despite their 50% pass mark. Parliament last Friday passed a resolution for the General Legal Council to compel the Ghana Law School to admit the 499 students who sat for the 2021 entrance exams and passed in accordance with the marking scheme as advertised. This follows a motion moved by deputy minority whip Ahmed Ibrahim, fine-tuned by the first deputy speaker who was presiding Joseph Osei-Owusu and repeated by Effutu MP and deputy majority leader Alexander Afenyo-Markin. In a sharp rebuttal, the Attorney General rejected the resolution by Parliament for the General Legal Council to intervene so that GSL will admit the 499 law students. In a statement to Parliament on Monday, November 1, the Attorney General said Parliament is “devoid of the power through the use of Parliamentary resolutions, to control the process of admission into the Ghana School of Law. There’s no space to admit you into law school – Akufo-Addo to 499 law students

President Nana Addo Dankwa Akufo-Addo says there is no space to admit the 499 law students who were denied admission despite attaining the 50 percent threshold in the Ghana Legal Council (GLC) examinations. Describing the situation as unfortunate, the President said government is working to resolve the challenge. “For the time being, there is no space in the law school for them. There are several others who unfortunately fell into the same pit. Maybe this group has been more vocal than their predecessors.” “I think the idea of more lawyers in the system is good for the health of the nation. We want a country that is governed by the rule of law. It means we need to have lawyers in all aspects of our national life guiding the development of our country. The conversation is ongoing and I am hoping that soon or later a solution will be found,” he said in an interview on Peace FM.   The 499 candidates who sat for the 2021 examinations were failed after a new quota system was introduced by the GLC. The new quota requires candidates to pass 50% in each of the A and B sections in the exam. The affected candidates have since been agitating and calling on the GLC to give admission to all 499 students who attained the 50 percent pass mark. The President admitted that reserving admissions for just a select few will not serve the country’s interest. “I myself, I think that idea of more and more lawyers in the system is good for the health of the nation. If we want a country that is governed by the rule of law, it means that we need to have lawyers in virtually all aspects of our national life guiding the development of our country so that the rule of law really makes sense,” he said. He believes it is a reasonable expectation for Ghanaians to demand a solution from him due to his status as a celebrated lawyer. “I think it’s a decent, reasonable expectation; I will not run away from it. The outgoing National Secretary of the Ghana Bar Association(GBA), Yaw Acheampong Boafo, has been elected President of the Association. He beat his only contender, Efuah Ghartey, wife of former Railway Development Minister, who is a second timer in the presidency contest having contested the 2018 election. Mr Boafo will succeed Anthony Forson under whose administration he served as National Secretary. Godfred Yeboah Dame, Ghana Attorney General has told to his colleagues at the 2021 Bar Conference to honor their fullest tax obligations. Addressing members at the 2021 Bar Conference in Bolgatanga, Mr Dame said, lawyers who decide to shy away from their tax obligations mean a gross violation of professional rules. According to Mr. Dame, the vigilance of lawyers throughout the years, which has ensured the protection of human rights and the welfare of society, is similarly required to guarantee the economic development of the country. However, he said in order to achieve that target, lawyers to desist from the practice of helping their clients to avoid or evade taxes and also take up the personal responsibility of leading by example. “The luxurious lifestyles of lawyers, riding in the most plush of vehicles and acquiring top-end properties, are hardly commensurate with the amount of taxes they pay. Over 6,000 Ghanaian lawyers, doctors evading tax — Finance Minister

Over 6,000 Ghanaian lawyers and doctors are not paying taxes, this is according to Finance Minister Ken Ofori-Atta. The country’s purse holder made this revelation in an interview on Asaase Radio where he also disclosed that 60,000 business people have been evading tax, per an exercise conducted by the Ghana Revenue Authority (GRA). “…We went through the exercise to sort of titrating to see what we’ve got, and we got about 60,000 businesspeople who were not paying taxes…some 5,000 or 6,000 lawyers are not. Some doctors [are not paying income tax]…so you begin to see all of these professionals, all of us on social media ranting against the government and [realise] that most of these people are not even paying taxes,” Mr. Ken Ofori-Atta shared. Having established that fact, he said Ghanaians should stop lashing out at government when things are hard as he encouraged businesses and the citizenry to at all times comply and pay taxes to help in the execution of projects and policies to develop the country. According to Ken Ofori-Atta, the current revenue target of the GRA gives him hope that government will be able to carry out projects to develop the country. “If GRA is telling us that we are targeting GHC57 billion for this year, it means that if you have half of that – let’s say GHC30 billion – another GHC30 billion is sitting there somewhere in the wings. “Now that’s an enormous amount of resources that we can tap into, to be able to fund development projects. And that’s what gives me the excitement and hope that we can really fund this development [agenda]. The exciting thing, after four years of the administration and being given the mandate for another four years, is that a lot of learning has occurred,” the Finance Minister noted.
