James Gyakye Quayson, the NDC Member of Parliament (MP) for Assin North, is currently on trial. However, the proceedings have been put on hold as Justice Mary Maame Ekue Yanzuh, the trial judge, is going on leave. Justice Yanzuh was one of the 12 judges who sat during the legal vacation between August and September and is now required to take leave. During a court session on November 22, when the prosecution was supposed to call its third witness, the case was heard in chambers, with Defence Counsel Tsatsu Tsikata present. The trial was subsequently adjourned. There has been controversy surrounding the absence of the accused, as his lawyers claim he is in Canada for a medical examination. The court has ordered the trial to continue in his absence, a decision that his lawyers are contesting at the Supreme Court. High Court rejects Gyakye Quayson’s application to halt proceedings pending judicial review
Lawyers representing James Gyakye Quayson, the Member of Parliament (MP) for Assin North, have had their application to stay proceedings at the high court dismissed by the judge. The application sought to halt the ongoing trial until a judicial review application, filed with the Supreme Court, was resolved. Presided over by Justice Mary Maame Ekue Yanzuh, the high court ruled that the application before the Supreme Court did not pertain to the provisions outlined in Article 130 of the 1992 Constitution. As such, the court was not obliged to suspend proceedings in the ongoing trial. Article 130 of the 1992 Constitution delineates the exclusive jurisdiction of the Supreme Court. It states that the Supreme Court shall have original jurisdiction in matters concerning the enforcement or interpretation of the Constitution, as well as matters arising from the question of whether an enactment exceeded the legal powers conferred on Parliament or any other authority under the Constitution. In its decision, the court noted that the application for judicial review before the Supreme Court related to a decision made by the High Court and did not involve an issue of constitutional interpretation as specified in Article 130 (1 b). Assin North: James Gyakye Quayson projected winner by NDC
The Opposition National Democratic Congress (NDC) has already activated jubilation for its candidate in the Assin North by-election. According to the party, its independent collation of results so far from the 99 polling stations across the constituency shows that James Gyakye Quayson had polled 17,205 votes representing 57.4% of valid votes cast whiles his main contender Charles Opoku of the New Patriotic Party (NPP) got 11,389 votes representing 42% of valid votes cast so far. Liberal Party of Ghana got 85 (0.28%) of the votes becoming the third candidate. Meanwhile, the Electoral Commission is yet to declare a winner. If the collated result by the opposition NDC is confirmed, it simply means James Gyakye Quayson is returning to Parliament. Assin North legislator granted GHS100K bail
Today, an Accra High Court has granted bail to the Assin North Member of Parliament (MP) Mr. James Gyakye Quayson in the sum of GHS100,000 with one surety. The Assin North legislator has been charged on five counts of forgery of passport or travel certificate, knowingly making a false statutory declaration, perjury and false declaration for office. According to Justice Mary Maame Ekue Nsenkyire, who presided over the case, the MP should be granted bail after he had pleaded not guilty to all five charges leveled against him. Meanwhile, the Lawyer for the embattled MP, Mr. Tsatsu Tsikata had prayed the court to grant his client a self -recognizance bail, but the court refused on the basis of the difficulties the bailiff had in serving the MP with the court process. However, Deputy Attorney- General (A-G), Mr. Alfred Tuah-Yeboah, also prayed the court not to grant the MP with a self-recognizance bail, arguing that the state went to great lengths in order to serve Mr. Quayson with the court process. Mr. Quayson was accompanied to the court for the first time today in the company of the National Chairman of the NDC, Mr. Samuel Ofosu Ampofo, two former Attorney -Generals (A-G), Mrs. Marietta Brew Appiah-Opong and Mrs. Betty Mould Iddrisu and many other party executives.
