The ceremony, held in Parliament, saw Mr. Quayson take the oath of secrecy and the parliamentary oath, followed by congratulations from Speaker Alban Sumana Bagbin. The Attorney General has put out list of cases which have been the subject of “unwarranted public commentary” as including “but not limited to: Republic vs. James Gyakye Quayson, Republic vs. Dr Stephen Opuni & 2 Others; and Republic vs. Cassiel Ato Forson & 2 Others”. According to him, “no immunity is conferred by a person’s position in parliament” or in “the judiciary” or by virtue of being a “traditional authority” or standing at the “Bar, or any official position, from the consequences of an interference in the administration of justice or an attempt to overreach a judgment to be delivered by the court in any matter”. The cases which have been the subject of unwarranted public commentary include but are not limited to, Republic vrs. James Gyakye-Quayson, Republic vrs. Dr Stephen Opuni & 2 Others and Republic vrs. Whilst respecting the freedom of all persons in Ghana to comment on any matter including cases pending in court, the AttorneyGeneral and Minister for Justice takes note that much of the recent commentary on many of the so-called high-profile criminal cases transgresses permissible limits of free speech, unduly interferes with the work of State Prosecutors performing their constitutional function of prosecuting crime in Ghana and tends to put unnecessary pressure on the courts. The Attorney-General respectfully reminds Ghanaians of the principle of the equality of all persons before the law enshrined in article 17(1) of the Constitution. No person living in Ghana, citizen or non-citizen, is above the laws of Ghana or immune from an application of same. The Attorney-General’s constitutional responsibility for the “initiation and conduct of all prosecutions of criminal offences” implies a duty to prosecute a crime committed in Ghana, after proper investigations have been conducted, irrespective of the political, race, colour, ethnic, religion, economic or social status of the culprit. State Attorneys assisting the Attorney-General in the performance of this hallowed constitutional mandate, operate under extreme pressure and are exposed to severe risks. They have the right to prosecute cases freely in a court of law just as private legal practitioners enjoy a right to defend their clients, free from abuse and attacks on their character. The decision to prefer a charge against an accused person is not made on the basis of a person’s political status, social or economic standing but on the strength of evidence subject to the scrutiny of the courts. An acquittal of a person by the courts does not imply malice on the part of the Republic in the filing of a charge. The perception that a crime committed by a person of high political standing in society should not be prosecuted is dangerous for society and must not be countenanced. The Office of the Attorney-General and Ministry of Justice observes that many of the recent comments by various persons on some criminal matters, particularly those mentioned above (widely publicised in the media), clearly exceed the bounds of acceptable speech as they seek to disparage prosecutors in the eyes of the public and frustrate prosecution of those cases. Some of the comments are orchestrated to pervert the course of justice and/or prejudice the fair hearing and determination of the cases. The Office of the Special Prosecutor (OSP) has published its half-year report for 2023, the report provided updates on its ongoing efforts to combat corruption in the country. The report highlights the completion of investigations into three significant cases, as well as the initiation of probes into 150 new corruption-related cases. Few of the completed cases mentioned includes: Charles Bissue – Secretary to the erstwhile Inter-Ministerial Committee on Illegal Mining (IMCIM): which originated from an investigative documentary titled “Galamsey Fraud” by Tiger Eye PI. The full report Introduction 1.1 The Office of the Special Prosecutor (OSP) is the gold standard and flagship specialised independent anti-corruption state agency in Ghana. It was created in 2017 under an Act of Parliament – Office of the Special Prosecutor Act, 2017 (Act 959) in pursuance of the objects of the United Nations Convention against Corruption. Two legislative instruments have also been enacted to augment the operation of Act 959. The first is the Office of the Special Prosecutor Regulations, 2018 (L.I. 2373), which regulates the management of human capital and discipline. The second is the Office of the Special Prosecutor (Operations) Regulations, 2018 (L.I. 2374). 1.2 The Office has the object of investigating and prosecuting specific cases of alleged or suspected corruption and corruption-related offences, recovering the proceeds of corruption and corruption-related offences, and taking steps to prevent corruption. 1.3 The Office exercises full police and law enforcement powers in the performance of its functions. 1.4 The Office is independent and unique in its mandate. II Developments 2.1 The Office concluded a substantial recruitment process for its initial establishment complement of staff. The Office received more than 6,000 applications contending for 249 positions cleared by Parliament and the Ministry of Finance. The exercise was conducted with the participation and assistance of the Public Services Commission; Attorney General and Ministry of Justice; Research Department of the Ministry of Foreign Affairs; Economic & Organised Crime Office; Commission on Human Rights & Administrative Justice; and Financial Intelligence Centre. There was also participation by the Governing Board of the Office comprising representatives from AntiCorruption Civil Society Organisations, Audit Service, Ghana Police Service, Economic & Organised Crime Office; Commission on Human Rights & Administrative Justice; Ministry of National Security, and Financial Intelligence Centre. The successful applicants are expected at post variously on or before 31 October 2023. The incoming officers would be a refreshing addition to ease the pressure on the overstretched skeletal staff and to assure enhanced and efficient operations of the Office. 2.2 In exercise of the corruption prevention powers of the Office, the Special Prosecutor, in August 2022 directed the Ghana Revenue Authority (GRA) to submit an Integrity Plan, to the Office, designed with the aim of preventing the corruption of the exercise of discretion by officials of the Customs Division of the Authority, especially in respect of the rendering of rulings, to assure the effective operation of the Customs Act, 2015 (Act 891) and the Revenue Administration Act, 2016 (Act 915). GRA complied with the directive in March 2023 and submitted the following designed and reworked documents: GRA Integrity Policy GRA Policy and Procedures on Advance Rulings iii. GRA Standard Operating Procedures on Advance Rulings GRA Integrity Plan Framework GRA Code of Ethics The OSP and GRA will work toward ensuring the implementation of these policies to reduce the incidence of corruption and improve the exercise of discretion at GRA. III Cases 3.1 In respect of the investigation and prosecution of specific cases of suspected or alleged cases of corruption and corruption-related offences, the Office first engages in intelligence gathering or “pre-investigation” to determine whether it should open investigation into a matter. The Special Prosecutor directs the opening of a preliminary enquiry or investigation where he determines that the matter is within the mandate of the Office. Where sufficient information is gathered, the Special Prosecutor directs the initiation of a full investigation. The Special Prosecutor directs the institution of criminal proceedings where it is determined that the Office has probative evidence to meet the standard of proof beyond reasonable doubt. 3.2 The Office takes especial care to safe-guard and protect the privacy and reputations of persons it investigates. To this end, the Office seeks to avoid unnecessary stigmatisation by conducting its operations with as little intrusion into the privacy of individuals and the business operations of companies as the circumstances permit 3.3 Thus, the Office only publishes the initiation or commencement of investigation where the Special Prosecutor deems the investigation in question to be at a threshold which dictates communication to the public. 3.4 The following are the various cases handled by the Office during the period under reference: A Prosecutions There has not been any convictions or acquittals in respect of the cases pending before the criminal courts during the period under review. Babies spend about half the time they’re asleep in the dream stage, called REM sleep. That stage is linked to brain activities, such as memory, nervous system function and self-control. And for a newborn, there’s no such thing as night and day. So they sleep and wake on their own schedule. But even with a newborn, you can start to shape your baby’s sleep habits for healthier lifelong rest. Developing a rhythm Newborns sleep 12 or more hours a day but just an hour or two at a time. Babies born before their due date, called premature, may sleep more than babies born at term. There may be no pattern at first. Babies wake up to eat and then fall back asleep. But after a couple weeks, babies will be able to stay awake longer, and then sleep for a longer time. A more regular sleep schedule comes with brain and nervous system growth and being able to go longer between feedings. After a few months many babies are on a regular three-times-a-day nap schedule and sleeping for longer periods at night. For caregivers, the age-old advice is “sleep when your baby sleeps. ” While it’s almost a cliche and sometimes impossible, getting enough sleep is as important for you as it is for your baby. In these first few months, caregivers often report that they are exhausted. Tired caregivers can find it hard to focus, remember details or see solutions to issues. MTN Ghana Wraps Up Y’ello Care With Commendations From Beneficiaries And Employee Volunteers
MTN Ghana has exceeded its target for this year’s 21 days of Y’ello care, reinforcing its position as a good corporate citizen through the program. The 2023 program which was held under the theme “Empowering Entrepreneurs to Unlock Growth and Job Creation for Communities” had employee volunteers from MTN Ghana training Indigenous entrepreneurs from all sixteen regions of Ghana. The initial target for this year’s Y’ello care was three thousand. At the end of the program, MTN Ghana employee volunteers were excited to have taken time off work to engage with four thousand and seventy (4,070) members of the community. The breakdown of the beneficiaries for this year is as follows: Youth Led – 2.420 Women – 1,480 Differently abled – 170 Adwoa Wiafe, Chief Corporate Services and Sustainability Officer said, “We are proud of the work our employees did in the community and we look forward to coming back soon to do a follow up of how this has improved their businesses”. Daniel Boateng, one of the employee volunteers said, “Having the opportunity to engage these entrepreneurs was not just fun, it was also a learning opportunity for us. By sharing our knowledge with the beneficiaries, we were also learning new ways of doing things.” Mavis Akosua Mensah, a beautician from Nsawam said, “I am so excited that through Y’ello care, we have been armed with information and skills that can help us grow our businesses. One of the things I will always cherish was the session on how we can improve Customer Service. I really learnt a lot about dealing with difficult customers.” Cecilia Amankwah, Country Director of Engage Now Africa, one of the partners for this year’s program, expressed her gratitude to MTN Ghana for helping to transform and empower Ghanaian youth, women and the differently abled. She said, ”Through this program, the beneficiaries have acquired free training that is not affordable on the open market. This has been a truly transformational time for the beneficiaries.” MTN partnered with other organisations across the country to embark on its annual 21 Days of Y’ello care. The partners were, Node 8, Duapa Werkspace, Eastern Hub, Ghana Chamber of Entrepreneurs with Disability, Agrico hub, Wan-hive, Northern Innovation hub, Dansyn Iso hub, Trisolace Company Limited and Noni Hub. On the last day of the program, MTN Ghana hosted some entrepreneurs who showcased their products at the company’s head office. MTN employees engaged the entrepreneurs and took the opportunity to buy some of their products. This year’s 21 Days of Y’ello Care is linked to MTN’s 5-year strategic priority to support local grassroots entrepreneurs and help them to develop and market their products.
