“The accused did not have the intention to defraud” Court clears Ghana First Company Limited

Ghana First Company Limited has been cleared of any wrongdoing against contractors working on its company’s toilet projects across the country. This is according to the court verdict intercepted by apexnewsgh.com which was signed by Nana Adoma Osei a Senior State Attorney for Attorney General. Apexnewsgh.com report Background Ghana First, as a sanitation provider company, started a project of constructing information technology-based places of convenience across Metropolitan, Municipal and District Assembly’s in marketplaces, lorry parks, and needy areas throughout the country and along the way, there was a misunderstanding. The misunderstanding between Ghana First Company Limited and its contractors started way back in 2019 with some agitations by contractors who claimed they have executed the project to a certain level and needed some money to continue. Following the misunderstanding between the two groups, the contractors reported Ghana First CEO to the police and he was invited by the police on March 16, 2021, and upon arrival, the CEO of Ghana First Company Mr. Frank Akuley was arrested and detained. However, after some days of being on remand, he was granted bail and was asked to report to the police every Tuesday and Thursday. Information gathered said aside that, The CEO properties which includes cars, passport, and accounts were ceased. Meaning he has no power over them. Meanwhile, after all these years of court battling between two parties, a verdict by Nana Adoma Osei a Senior State Attorney for Attorney General intercepted by this platform says, “According to the accused, due to the fact that MMDAs delayed in producing the land documents for them to submit to GCB for the release of funds for the company’s operations, it became necessary to generate funds to ran the company. He stated that it was the reason why the company started charging 2% of the contract sum from the contractors from June 2018 to the first quarter of 2019 which was used to fund operations”. The verdict further states: “In order to successfully sustain a charge of defrauding by false pretences against the accused, there must be evidence of intention to defraud. However, from the evidence available in the docket, the accused dealt with the complainants on the basis of the MOU, which at all material times was an existing and binding MOU”.“Accordingly, the accused never made a false statement of fact when he told the complainants that he had funding from Thermodul.” The ruling said “The MOU was terminated by Thermodul on 2nd April 2019 at a time when a lot of complainants had already entered into a contract with Ghana First on the basis of MOU”. However, concluding on the verdict, the State Attorney says: “A careful and painstaking evaluation of the docket reveals that the accused did not have the intention to defraud. The issues in contention are civil nature. The parties are therefore advised to explore the option of ironing their issues out in a civil suit. “From the forgoing, we disrecommend the prosecution of the accused person. Bolgatanga MCE response to Ghana First Company Limited

The Bolgatanga Municipal District Chief Executive Mr. Rex Asanga has responded to the Ghana First Company Limited saying he was [misunderstood] by his pronouncement. Mr. Asanga on Wednesday, August 24, 2022, during an interview on Yem Fm monitored by Apexnewsgh.com was responding to issues regarding sanitation in the Bolagatanga Municipality and the effort by the assembly is making to eliminate the Canker of Open Defecation (OD) Meanwhile, responding to the Sanitation Issue, he mentioned that the assembly is initiating a dialogue with the contractors of Ghana First Company Limited to see how they can complete the toilet and put it to use because the company has since disappeared “We also want to increase the number of toilets we have. I don’t know if you have heard about Ghana First toilets. There was some… I don’t know whether is an NGO or an Organization that came around and got people to start building toilets and the people started building the toilet almost to completion and they disappeared up till now. So, we are initiating some dialogue with the contractors of those toilets to see if we can bring the toilets on board to add. I agree with the one who sent in the message that we need many more toilets in the system”. He maintained However, the MCE also maintained: “Ghana First is not a project of the assembly, is an organization that awarded contracts across the country to individual contractors to construct toilets and they disappeared and left the contractors and some of them have spent all their investment in the construction of the toilets and they can’t find the employer”. Following the pronouncement by the MCE, Ghana First Company Limited issued written a letter requesting a retraction from the MCE for what they claim is a false statement he made against them. ”The letter says: We have intercepted a publication to the effect that, you cannot find Ghana First Company Limited anywhere for discussions on the toilet facilities. You further stated that you were going to mobilize the contractors for them to continue to complete the projects and run the projects with the Assembly”“We disagree with your statement that, we are nowhere to be found. We are still operating from our office and we have not relocated”. “We, therefore, wish to advise you to retract your statement in order to avoid any legal action to be instituted against you”. “We are by this letter, advising you to retract the statement within 14 days upon receipt of this letter, in order to avoid any legal action being instituted against you. We count on your usual cooperation”. The letter as sighted by Apexnewsgh.com was copied to the Office of the President, the Ministry of Local Government and Rural Development, and the Ministry of Justice and Attorney General’s Department. However, in responding to the letter issued by Ghana First Company Limited which was demanding the MCE retractions, Mr. Asanga has responded. Speaking on A1 radio a local radio station in the Bolgatanga Municipality on Monday October 10, 2022 monitored by Apexnewsgh.com, Mr. Asanga said he was completely misunderstood. According to him, “When I say they are nowhere to be found, i didn’t mean that they are not there, all I meant was that, the work is at a standstill” He said “I went to Yem radio and the same question was asked to me about sanitation situation issues in the Bolgatanga Municipality and what the Assembly was doing and in my response, I spoke about the fact that Ghana First has awarded contracts for contractors to put up toilets and somewhere along the line, the toilets are not completed”. “And, I think I made a statement that ‘they are nowhere to be found. I think they heard it and they are not very happy. They have written to me expressing their dissatisfaction over the matter. I want to use this platform to say that I was completely misunderstood. When I say they are nowhere to be found, i didn’t mean that they are not there, all I meant was that, the work is at a standstill, the work has stalled. Angry contractors vow to expose MMDCs in Akufo Addo’s government

A group of aggrieved contractors has said they will not have any other option than exposing all Metropolitan, Municipal and District Chief Executives who collected bribes from them before awarding contracts for the construction of ultramodern toilet facilities across the country. On Tuesday, the contractors in a press conference said some MMDCE’s collected between 5 to 15 percent from them, before awarding them contracts knowing very well that Ghana First Company limited took only 2 percent. The decision came up following the government and for that matter Ghana First Company’s failure to pay them their contractual sum after 60% completion of projects. The contract was awarded to individual contractors between the period 2017 and 2019 and all contracts according to them were prefinanced. Per the contractual agreement, after 60% completion of the project, “the amount involved shall be paid to the contractor”. They said at a press briefing that ” all contractors have complied and fulfilled the first part of the agreement, however, not a pesewa has been paid any of us”. Should government refuse to adhere to their concerns, they have sworn heaven and earth to call and mobilize all communities where some of these uncompleted toilet facilities are being constructed to demonstrate massively against the government and Ghana First Company. They said they will again press upon fellow contractors, families and workers not to vote. Below is their Press Statement PRESS STATEMENT DELIVERED AT THE PRESS CONFERENCE HELD BY NEW WORLD CONTRACTORS ASSOCIATION OF GHANA ON TUESDAY 29TH SEPTEMBER, 2020 AT THE CLOGSAG CONFERENCE HALL, ADUM – KUMASI BY: EMMANUEL DAPAAH – CHAIRMAN Good day, Ladies and Gentlemen. We thank you all for honoring our invitation. We have gathered here as members of the New World Contractors Association of Ghana; that is contractors who have been contracted by Ghana First Company Limited to build ultra-modern toilet facilities across the length and breadth of our country. Ghana First Company Limited is working in collaboration with the Local Government and Rural Development Ministry and Ministry of Water and Sanitation. In fact, it is the MMDCE’s that grants the site for the project. The project specifications and cost of each are stated below: a) 14 seater at the cost of Two Hundred and Ninety Thousand, Four Hundred and Eighty-Four Ghana Cedis (GHC 290,484.00), b) 16 seater at the cost of Three Hundred and Twenty-Six Thousand, Two Hundred and Fifty-Nine Ghana Cedis and Thirty Six pesewas (GHC 326,259.36), c) 20 seater (A) at the cost of Five Hundred and Three Thousand, Nine Hundred and Thirty-Five Ghana Cedis (GHC 503,935.00), and d) 20 seater (B) at the cost of Three Hundred and Thirty-Three Thousand, Six Hundred and Seventy-Six Ghana Cedis (GHC 333,676.00). TERMS OF REFERENCE PER CONTRACTUAL AGREEMENT 1. The contracts were awarded to individual contractors between the period 2017 and 2019. 2. Contractors were to pre-finance the project and after 60% completion, the amount involved shall be paid to the contractor. 3. Furtherance to that, a letter was issued to each contractor specifying certain conditions. Copies of the letters have been provided here. We are stating that all contractors have complied and fulfilled the first part of the agreement; however, not a pesewa has been paid any of us. Meanwhile, the Vice President, Dr. Mahamudu Bawumia in delivering his address on the infrastructure projects executed by his government referred a lot of the projects we have done. How can we be denied our money but for the government to claim credit for those projects? We see this as a deliberate attempt by the Government and Ghana First Company to kill the spirit of contractors in this regard. Our members procured loans from banks to execute the projects. Now, we are being chased by those banks for repayment. Several appeals to Mr. Frank Akuley, the C.E.O. of the Ghana First Company Limited have fallen on death ears. He is blaming the government for the delays. We are using this medium to draw the attention of the government to our plight. The government should come out to state its position on this matter. We don’t want to believe that this is a scam that has been endorsed by this government. REQUEST We are giving the government 10 days to respond to the following issues: 1. Explain to us the contractors, its position and involvement in the Ghana First Company issues, 2. Why the sector ministers gave Ghana First Company introduction and support letters knowing the company’s inability to pay, 3. Why the MMDCE’s refusal to perform their part of the contract with Ghana First Company by providing the land title documents as per their undertaken letters, (sample shown) 4. Why the sector ministers: Minister of Local Government and Rural Development and Minister of Water and Sanitation have refused to respond to the Ghana First Company blaming the Local Government for delaying on their part to raise funds to pay the contractors, 5. Why the government captured our projects (Ghana First Toilet Facilities) as its achievement during the town hall meeting in Accra by the Vice president, Dr. Mahamudu Bawumia, when during the same town hall meeting in Kumasi, we were told by the Information Minister, Kojo Oppong Nkrumah that it is a private project. 6. The government should intervene by helping Ghana First Company to have access to funds and pay the contractors. OR The government should take over the projects and also engage us, the affected contractors, on the way forward. If the government refuses to adhere to our concerns, we will take the following actions. a) We will call and mobilize all the communities where some of these uncompleted toilet facilities are being constructed to demonstrate massively against the government and Ghana First Company. b) We will press upon members, their families, and workers not to vote and we will campaign massively against the government in this year’s elections. c) Lastly, we will expose all the MMDCE’s who took between 5% – 15% from our members before awarding the contracts knowing
