Haruna Iddrisu Accuses Speaker Alban Bagbin of Constitutional Violations

Former Minority Leader in Parliament, Mr. Haruna Iddrisu, has raised concerns over Speaker Alban Bagbin’s alleged failure to adhere to the rules of the constitution. According to Mr. Iddrisu, Speaker Bagbin did not comply with Article 124 of the 1992 Constitution which outlines procedures for selecting members of the Parliamentary Service Board following changes in the Minority group last year. Mr. Iddrisu voiced his grievances during discussions to establish a committee to assist the Speaker in appointing members to the Parliamentary Service Board after recent changes in the Majority group. He emphasized that the changes in Minority leadership occurred over a year ago, questioning the actions taken by the Board in collaboration with the Speaker and Ato Forson, which he deemed unconstitutional. In a statement, Mr. Iddrisu emphasized, “The Speaker, Mr. Alban Bagbin, is not above the Constitution. He’s not above the rules, and so, when we’re talking about wrong things, it’s a problem when they break the rules of the Constitution.” However, Majority Leader, Mr. Alexander Afenyo-Markin, refuted Mr. Iddrisu’s allegations, asserting that Speaker Bagbin followed the appropriate procedures when Iddrisu vacated his position. Mr. Afenyo-Markin defended the Speaker’s actions, suggesting that Mr. Iddrisu’s claims were unfounded. The dispute highlights ongoing tensions within Parliament regarding adherence to constitutional provisions and the proper execution of parliamentary duties. The Tamale South MP, on Sunday, March 19, 2023, was accompanied by some Northern regional executives, constituency executives, and Members of Parliament among other bigwigs of the party, to submit his nomination at the constituency office. Minority Leader Haruna Iddrisu wants Parliament to summon the Minister of Finance Ken Ofori-Atta and the Governor of the Bank of Ghana (BoG) Dr Ernest Addison to appear before the House to explain to them the measures that have been put in place to deal with the economic challenges. Mr Iddrisu stated on the floor of the House on Tuesday October 25 that the challenges are becoming unbearable to Ghanaians hence, the need to invite the Finance Minister and the Governor of the BoG to address the House. “The Minister of Finance and the Governor of the Bank of Ghana ,is to appear in Parliament to explain the measures that have been put in place to resolve the economic challenges,” the Tamale South lawmaker said.This comes at a time some Members of Parliament on the side of the governing New Patriotic Party (NPP) have asked President Nana Addo Dankwa Akufo-Addo to sack the Finance Minister Ken Ofori Atta and the Minister of State in charge of Finance Charles Adu Boahen. Supreme Court Chases NDC MPs – Over Double Salary

THE SUPREME Court has ordered that all double salary Members of Parliament (MPs) and ministers should be served by way of substituted service after swerving service of the writ of summons issued against them. Bono Regional Chairman of the New Patriotic Party (NPP), Kwame Baffoe, also known as Abronye DC, filed a suit against the former ministers including Minority Leader Haruna Iddrisu, challenging the payment of their salaries to them between 2009 and 2016 when they doubled as MPs and ministers or deputy ministers. The court gave the order after the lawyer for Abronye DC, Seth Gyapong Oware, informed the court that the affected MPs and former government appointees are evading service of court processes. Subsequently, the court directed that the processes should be posted on the notice boards of Parliament, Supreme Court and the Law Court Complex. It also directed further publication in the Daily Graphic and DAILY GUIDE newspapers within 14 days. The defendants are Haruna Iddrisu, Alhassan Azong, Fifi Fiave Kwetey, Eric Opoku, Abdul Rashid Hassan Pelpuo, Emmanuel Armah Kofi Buah, Edwin Nii Lantey Vanderpuye, Mark Owen Woyongo, Comfort Doyoe, Cudjoe Ghansah and Aquinas Tawiah Quansah. The rest are the Controller and Accountant General and the Attorney General. It is the case of Abronye DC that the affected MPs and former government appointees who received double salaries as MPs and ministers or deputy ministers is inconsistent with the constitution. He contends that per Article 98 of the  Constitution, the practice is unconstitutional, null and void. He is, therefore, praying the Supreme Court to declare the payment as a violation of the constitution and an order to compel the MPs to refund the double salaries paid to them. Abronye wants the Supreme Court to compel the former ministers/deputy ministers who served under the Mills-Mahama administrations, who were also elected MPs between 2009 and 2016, to pay back to the Republic, all double salaries received within the period. The presiding judge, Justice Clemence Honyenuga, while granting the application, said “good and substantial reasons have been urged for the grant of the application.” —Daily Guide

E-Levy: ‘We want it fixed at 1%, we fear for double taxation–Minority Leader

The Minority Leader in Parliament, Haruna Iddrisu, has said they in the minority will be ready to accept a reduction of the proposed E-levy to 1% than the initial proposed 1.75%. The Minority leader made the pronouncement during the 10th-anniversary launch of the Ghana Chamber of Telecommunications in Accra on Thursday, December 2, 2021, According to him, “…a week ago, we said no, we won’t accept e-levy but having listened to officials in government, including the Minister of Finance, I am convinced to accept a departure from my original no to accepting a one percent E-levy,” he stated. “Pegging the E-levy at 1% was a great contribution to fiscal consolidation and would ensure the economy did not collapse going forward”, he stressed. He Added: The digital economy was doing well and had facilitated a revolution in financial inclusion, hence it was unwise to overburden the telecommunications sector. “We are not against it, but we want it fixed at one percent. We fear for double taxation because we already have the communication services tax,” he said. Mr. Iddrisu initially disagreed with the deduction fee for business transactions not exceeding the GH¢100.00 threshold a day and called for it to be pegged at GH¢500.00. But in a similar vein, he suggested that the money be pegged at GH¢300.00 after revising his notes. The Minority leader said, Ghanaians needed to pay taxes to help develop the country, but not one that would further overburden their tight purse. However, in an interview with the Ghana News Agency Dr. Kenneth Ashigbey, the Chief Executive Officer of the Ghana Chamber of Telecommunications alluded to the responsibility of paying tax for development considering the budget deficits and debts. He said the way taxes were introduced to generate revenue must be looked at, so it did not become inimical to the government’s digitalization drive and financial inclusion. The government’s push for entrepreneurship amongst the youth for job creation in the face of a 1.75% e-levy was a matter of concern, Dr. Ashigbey said, and that the Chamber was engaging government to see the best way out. On the issue of widening the tax net, he said merchant payments should be exempted completely from the e-levy. “The Chamber believes that artisans including masons, dressmakers, and painters get paid after work done and do not pay tax. They need to be part of the merchant ecosystem, and to do so there must be no levy on merchant payment,” he said. “Once their wallet is taxed, they will venture into the merchant ecosystem, it gives government visibility of revenues they make. The minority in parliament has said the action of the military high command in connection to the withdrawal of the Speaker of Parliament’s military security detail is a politically motivated and calculated one to diminish the speaker Alban Sumana Kingsford Bagbin confidence in his bid to impartially and independently steer the affairs of the legislative arm of government. The minority’s position came after the military high command announced the withdrawal of the military protection of the Speaker. According to the military command, the soldiers assigned to the Speaker did not follow the proper procedure. Below is the full minority statement: STATEMENT BY THE PARLIAMENTARY CAUCUS OF THE NDC ON THE WITHDRAWAL OF THE MILITARY SECURITY DETAIL OF THE SPEAKER OF PARLIAMENT, RT. HON ALBAN BAGBIN BY THE NANA AKUFO ADDO LED GOVERNMENT.                              The Minority in Parliament is saddened and strongly denounce the withdrawal by President Akufo-Addo’s government of the military detail attached to the office of the Speaker of Parliament, Rt. Hon Alban Bagbin with effect from the 14th January 2022. It is pertinent to note that the only reason given for the shameful withdrawal of Mr. Speaker’s security detail is that the attachment was done without following the proper procedure. Curiously, the government fails and/ or omits to spell out the procedure for the attachment of military personnel to high profile personalities such as the speaker of Parliament. If the action of the military high command is in good faith, the irregularity in relation to the attachment could be rectified without necessarily having to withdraw the personnel. The only logical conclusion a reasonable mind would draw with respect to the failure of government to indicate the nature of the procedure supposedly breached by Mr Speaker’s outfit is that proper procedure was followed for which reason the military high command had no difficulty attaching the military personnel in question to his office. Indeed, the Clerk to Parliament on the 21st January 2021 did write to the chief of staff of the Armed Forces and duly requested the attachment of the military personnel in question. At this point, the chief of staff did not detect any procedural irregularities in relation to Mr Speaker’s request. However, one year on the same chief of staff who on behalf of the military high command granted the request now wants Ghanaians to believe that he acted in error in the first instance? The posturing of the chief of staff in this regard is, to say the least, preposterous. The minority states further without any equivocation that the attachment of military personnel to the office of the speaker is not an isolated incident at all. For instance, members of the executive branch of government other than the president and Vice President who are below the speaker of Parliament in terms of status and rank as provided for in the constitution have at various times had soldiers attached to their offices. A notable example is the current Attorney General and Minister for Justice who, even as deputy Attorney General had a soldier for his bodyguard. Another example of a state official below the speaker in terms of status and rank who roams town with military protection is the chairperson of the Electoral Commission, madam Jean Mensa. Flowing from the above, the minority is certain that the action of the military high command relative to the withdrawal of Mr Speaker’s security detail is politically motivated and calculated to diminish his confidence in his bid to impartially and independently steer the affairs of the legislative arm of government. In the circumstances, the minority shall hold the government of President Akufo-Addo responsible should the security of Rt. Hon Alban Bagbin, the speaker of Parliament be compromised in any way. We further call for the immediate withdrawal of the letter with ref no: GH/ 1002/ 01/ COS written on behalf of the armed forces by the chief of staff and purporting to withdraw the military personnel attached to Mr Speaker’s office.
