Election petition before the Supreme Court had political dimensions aside the legal—Martin Kpebu

Martin Kpebu a private legal practitioner, has revealed that the ongoing election petition before the Supreme Court is wearing a political lance aside the legal. Mr. Kpebu who spoke on Joy News PM Express programme monitored by Apexnewsgh.com, stressed that the opposition NDC, whose flagbearer John Dramani Mahama is the petitioner in the case, is selling what he described as ‘the case of a stolen verdict’. “This case is not purely a legal case; it is also very political. What I see at play here apart from the legal aspect is that NDC is seriously selling the case of a stolen verdict. Seriously selling”. He stated According to Mr. Kpebu, what is at the bottom of the election, is that EC made errors and somebody benefitted “So, what is happening is that each day as we get up and talk about this case, what is at the bottom of it (is), that the EC made some errors, and then to the layman, that somebody benefitted,” he submitted. However, the petitioners have registered some level of displeasure over a number of rulings and directions on case management issued by the court.  Apexnewsgh.com/Ghana/Ngamegbulam Chidozie Stephen Please contact Apexnewsgh.com on email apexnewsgh@gmail.com for your credible news publications. The portal was opened in November 2020 and ended in December 2020, The Director in charge of Business Research and Skills Development at the Head office of the Nation Builders Corps (NABCO) Mubarak Bowan in an exclusive interview has told Ngamegbulam Chidozie Stephen of Apexnewsgh.com, that after the official Career Pathways registration on Saturday, December 5, 2020, a grace period of about 4 to 5 days will be given to beneficiaries who were unable to complete their registration due circumstances beyond their control before a mob up exercise. Withdraw the petition case, we will contribute and pay the fine–NDC activist to John Mahama

Dzifa Gunu a political activist and a member of the opposition National Democratic Congress (NDC) in a Facebook post has given what looks like a short and simple advise to the NDC 2020 Presidential candidate John Dramani Mahama. Mr. Gunu believes, withdrawing the petition from Supreme Court, is better than to continue, knowing that the Court has a predetermined stance on the petition brought before it. The political activist made this known through his post after the court adjourned its sitting to Tuesday January 26, 2020. He further stressed, that the court is likely to fine John Dramani Mahama for the petition withdrawal, insisting they will contribute and pay. “Dear H.E.  John Dramani Mahama, they will not give you justice, please withdraw the case, the worst they will do is fine you and we will contribute and pay”. Election Petition: Dominic Ayine explains reason for his ‘misconduct’ in court

A member of the legal team for the flagbearer of the National Democratic Congress, Dominic Ayine, has explained that the reason for his misconduct earlier in court today was because he was shocked at the proceedings in court. The Chief Justice, Justice Anim Yeboah, chided the former Deputy Minister for Justice and Attorney General, Dominic Ayine, for continuously raising objections while the timelines for the hearing were being readout. According to the Supreme Court, the decision had to be taken looking at the strict timelines guiding the election adjudication dispute as contained in the constitutional instrument (C.I) 99. The judges decided after the parties presented their memorandum of issues. “I saw you murmuring to your colleagues during the hearing and you should know better. You keep murmuring which I think is not fair. Please out of the respect for you, don’t do that again,” the CJ warned. But the NDC MP for Bolgatanga East, in defense, told the media that he reacted out of shock; noting that the parties involved in the case were not consulted in the decision-making process which he said should not be the case in the practice of the profession. Dominic Ayine further argued that the 42-day timeline given by drafters of the rules for the election petition means that the court can deliver within the period thus questioned the urge for a ‘speedy’ trial. A situation, he said, he has never seen happening in his 25-year experience as a legal practitioner. “You cannot now begin to truncate and deny the parties the right to be able to file, for instance, preliminary applications that are mandated and allowed by law just because you want a speedy trial.” “And I was shocked at what was happening and you all realized that the CJ singled me out that my body language was inappropriate but that is because I was very shocked that after 25 years of law practice, I have never seen this happening; that a court will arbitrarily announce the timeline for the party without consultation.” Mr Ayine, however, wondered why neither of the parties did oppose the decision by the 7-member panel. In his words, “I had occasioned to ask Mr. Akoto Ampaw why he did not object to the entire deadlines and sitting down there. It reminded me of an inscription that was on the desk of my secondary school rector that “don’t confuse me with the facts, my mind is made up”. Meanwhile, below is the roadmap for the timeline of the hearing 1.Mode of trial – The petitioner and their witnesses shall file witness statements with exhibits if any, by 12 noon of Thursday, January 21, 2021. 2. The witness statements shall be filed on the counsel for the respondents by close of day on Thursday, January 21. 3. The respondents and their witnesses if any, shall file their witness statements with exhibits, if any by close of day on Friday, January 22, 2021. 4. The first and second respondents shall file their submissions on the preliminary objections raised to the petition by 12 noon on Friday, January 22, 2021. 5. The registrar shall ensure service of the preliminary objections by close of day, Friday, January 22, 2021. 6. The petitioner shall file any response to the submission of the preliminary objections by noon on Monday, January 25, 2021. 7. The registrar shall ensure service of the petitioner’s response by close of day on Monday, January 25, 2021. 8. The ruling on the preliminary objections would be incorporated in the judgement of the court. 9. The court shall sit on Tuesday, January 26, 2021, for the hearing of this petition. You cannot blame the failure of a bad farm on your tools of implementation. Frank Davies response to Tsikata

Mr Frank Davies one of the lawyers of President Nana Addo Dankwa Akufo-Addo has said, “you cannot blame the failure of a bad farm on your tools of implementation”. Adding that, Your farm is your farm and it depends on how you cultivate it so we should not ponder over this repeated rhetoric of sacrificing justice for expedition.” Mr. Davies, Vehemently rejected the claims made by lead counsel for the petitioners in the Election Petition, Tsatsu Tsikata that justice should not be sacrificed for expedition. Mr. Tsatsu Tsikata had told the Supreme Court on Monday that as much as the court may want to go by the timelines specified in C. I 99 for the adjudication of election petitions, it should not be done in at back side of justice. Tsikata was reacting to orders by the court for parties file their witness statements by 12 noon Thursday, January 21, a timeline the lawyer deemed too short. According to him, the Supreme Court’s insistence of such a short timeline is not justified in law. But the bench explained the modification of the law which culminated in C.I 99 requires the court to operate within strict timelines, a requirement the court cannot compromise. The bench was also of the view that lawyers should have known that they will be required to file witness statements and that those should have been prepared ahead of time. But, dissatisfied lead lawyer for the petitioner told the court, adherence to those timelines should not injure justice. “Justice cannot be sacrificed for expedition”, he said. However, engaging the media after proceedings, Mr Frank Davies said, “What is meant by sacrificing justice on the altar of expedition?” “Justice delayed is justice denied. So, what is it? They are just not ready. They were advocating for a live broadcast of proceedings and now everybody is seeing what is happening in court. Everyday lead counsel for the petitioners is making one complaint or the other.” “You cannot blame the failure of a bad farm on your tools of implementation. Your farm is your farm and it depends on how you cultivate it so we should not ponder over this repeated rhetoric of sacrificing justice for expedition.”  Apexnewsgh.com/Ghana/Ngamegbulam Chidozie Stephen Please contact Apexnewsgh.com on email apexnewsgh@gmail.com for your credible news publications. John Mahama and his team are shifting the goal post–Gary Nimako Marfo

A member of the NPP’s legal team Gary Nimako Marfo said John Dramani Mahama of NDC who happens to be the petitioner in the 2021 election petition hearing is shifting the goal post with the mind to unduly delay the court processes. Nimako who was speaking on Peace FM’s Kokrokoo morning show monitored by Apexnewsgh.com said, the foundation of the John Dramani Mahama case should be pink sheets. Saying if the petitioner does not have it, on what basis are they claiming to have issues with the outcome of the December 7 elections  “The foundation of your case should be pink sheets. If you don’t have them, on what basis are you claiming to have issues with the outcome of the vote? How do you know that someone did not get the 50% plus one threshold”? He questioned “The goal post keeps shifting. As at the time they left the court (January 19), they could not tell the panel that they intend even to file any process to request for any documents from the EC. From the court, they went straight to do that”. “So from behind, you can see clearly that the matter before the courts is such that Mr. Mahama and his team are not interested in the court to get to the substance of the matter,” he pointed.  Apexnewsgh.com/Ghana/Ngamegbulam Chidozie Stephen Please contact Apexnewsgh.com on email apexnewsgh@gmail.com for your credible news publications.
