Kassena Nankana West District Assembly’s Breach of Constitution: A Threat to Democratic Principles?

Maxwell Akanuwe, assembly member for Longo electoral area have raised concern that the Assembly led by District Chief Executive Hon. Gerard Ataogye, has violated the 1992 constitution by failing to organize the second leg of the Assembly presiding member’s election. Apexnewsgh reports

The election was expected to take place within 10 days after the initial failed election on February 12, 2024, as mandated by the constitution.

This breach of the constitution has raised concerns among well-meaning members of the district, who are displeased with the Assembly’s actions. The failure to hold the election as required has sparked questions about the Assembly’s commitment to upholding the rule of law and democratic principles.

The constitution’s clear guidelines for the election process were disregarded, leaving many to wonder about the implications of this breach. The district’s residents are eagerly waiting for a resolution to this situation, and the Assembly must take prompt action to address this constitutional violation.

Following the Assembly’s failure to hold the second leg of the Presiding Member’s election, 23 out of 46 elected Assembly members have taken action.

In a letter dated June 12, 2024 sighted by this platform, Hon. Maxwell Akanuwe, Assembly member for Longo electoral area and other wrote to the District Coordinating Director, requesting a meeting to consider the election of a Presiding Member (PM).

This move comes after the Assembly’s unconstitutional delay in holding the election, which has spanned 126 days from February 12, 2024, to June 17, 2024 as at the time for this publication. The members’ letter is a clear call to action, urging the Assembly to address this breach and adhere to the 1992 constitution’s guidelines.

The meeting request is a significant step towards resolving the impasse and ensuring the district’s democratic processes are upheld. The Assembly’s response to this request will be closely watched, as the members and residents of the district eagerly await a resolution to this constitutional crisis.
