Innocent After 28 Years: American Man Finally Exonerated After Wrongful Imprisonment for Rape

Prosecutors have announced that Gerardo Cabanillas, a 46-year-old American who spent nearly three decades in prison for kidnap, robbery, and rape since 1995, has been declared innocent and freed.

Cabanillas was convicted in 1996 and spent 28 years behind bars after confessing to being one of two armed men involved in the attack. They approached a couple, forced the man out, and drove the woman to an abandoned house where both raped her.

However, the Conviction Integrity Unit of the District Attorney’s office reexamined the case, leading to a judge reversing Cabanillas’ conviction, finding him factually innocent, and ordering his permanent release.

The Innocence Project, which requested DNA testing on the rape kit in 2019, played a crucial role. The results revealed that two other individuals were actually responsible for the assault.
