CEO of the Railway Development Authority, Yaw Owusu in Trouble

South Dayi Member of Parliament (MP), Rockson-Nelson Dafeamekpor, has taken legal action against the Chief Executive Officer (CEO) of the Railway Development Authority, Yaw Owusu. Apexnewsgh Reports

Mr. Dafeamekpor is challenging the extension of Mr. Owusu’s post-retirement contract beyond the maximum five-year engagement period allowed by the Constitution.

In a filed writ, the National Democratic Congress (NDC) MP has requested the court to make declarations based on the interpretation of Article 199(4) of the 1992 Constitution as amended by the Constitution of the Republic of Ghana (Amendment) Act, 1996.

The MP contends that the CEO is not entitled to the purported one-year post-retirement contract extension, spanning from December 18, 2023, to December 17, 2024, and seeks the revocation of the extension.

Among other reliefs sought by Mr. Dafeamekpor include pointing out a previous two-year post-retirement contract extension granted to the CEO, which allegedly violated the Ministry of Finance’s letter dated August 5, 2022, suspending approvals for such contracts except in cases of critical skills shortages.

The legal action follows concerns raised by the MP over the extension of Mr. Owusu’s contract, alleging a breach of Constitutional provisions regarding the tenure of public servants. The case aims to clarify and rectify the extension of the CEO’s post-retirement contract and question its validity within the constitutional framework.
