IMANI Ghana and Security Expert Refile Suit Against Executive Over Security Agency Appointments
IMANI Ghana and security expert Kwasi Aning have filed a new lawsuit challenging the appointment of heads of security agencies by the executive. This comes after withdrawing an earlier suit filed at the Supreme Court, which was struck out on Wednesday, June 5, 2024.
The plaintiffs are seeking a declaration that the President lacks the authority to terminate the appointment of heads of security agencies unless there is proven misconduct or misbehavior. They argue that the Constitution guarantees the tenure of these office holders, and the President’s power to appoint new heads is limited to instances where the previous office holder has died, retired, or is incapacitated.
The suit specifically targets the offices of the Chief Fire Officer, Inspector General of Police, Director General of Prisons Service, and Comptroller General of Immigration Service. The plaintiffs contend that the President’s actions violate the constitutional rights of these office holders and perpetuate a concerning trend of compelled terminations by new governments.
The Supreme Court, led by Chief Justice Gertrude Sackey Torkornoo, expressed disappointment at the withdrawal of the initial suit, noting that it had garnered significant public interest. However, the plaintiffs’ counsel, Paa Joe Akuamoah Boateng, explained that the withdrawal was necessary to refile the case in light of new developments.
The refiling of the suit highlights the ongoing debate about the limits of executive power and the protection of constitutional rights in Ghana. The plaintiffs’ demands for a consequential order to restrain the President from dismissing or removing security agency heads without due process have significant implications for the rule of law and democratic governance in the country.
