President John Dramani Mahama had taken decisive action in one of the most consequential legal matters of the year.
With immediate effect, he removed Chief Justice Gertrude Araba Esaaba Sackey Torkonoo from office.
The President’s decision, announced on September 1, 2025, was not made lightly. It followed the strict procedures outlined in Article 146(9) of the 1992 Constitution. Earlier that year, a petition had been filed by Daniel Ofori, a concerned Ghanaian citizen, prompting the establishment of a special investigative committee under Article 146(6) to look into the allegations.
After weeks of diligent review, the committee completed its investigation. Their findings were clear: grounds of “stated misbehaviour” under Article 146(1) had indeed been established against Chief Justice Torkonoo. Based on this, the committee recommended her removal from the highest judicial office in the land.
Respecting the Constitution and upholding the rule of law, President Mahama moved to implement the committee’s recommendations immediately. The announcement of her dismissal was delivered by Felix Kwakye Ofosu, the Member of Parliament and Minister for Government Communications, who also serves as the President’s spokesperson.
This event marked a significant moment in Ghana’s constitutional history, underscoring the nation’s commitment to accountability, due process, and the principles enshrined in its supreme law.
