Manner of attempted arrest of Sosu offends Constitution — Bagbin

Speaker of Parliament has reacted to the manner in which the police attempted to arrest Mr Francis-Xavier Kojo Sosu, MP of Madina Constituency as offending the Constitution of Ghana. He described the attempted arrest of the legislator last Sunday, 31st October 2021, in church as ”surreptitious”, offending both the letter, and spirit that underpins the current 1992 Constitution of Ghana. “The appropriate procedure is to secure from the Speaker, a certificate that the Member in question is not attending Parliamentary Business. Anything short of this should not be entertained by the House,” Mr Eric Owusu Mensah, Deputy Clerk of Parliament, acting for the Clerk of Parliament, wrote in a press release on the instructions of the Speaker. The release made available on the WhatsApp platform page of the Parliamentary Press Corps, said the Speaker has taken note, also, of press releases and the posture of the Police Service including the interdiction of Inspector Daniel Agbavor, the Police Officer providing personal protection of Mr Sosu. According to the release, the Speaker found it difficult to comprehend the attempted arrest of the legislator, and that “the Speaker acknowledges that Members of Parliament are not above the law.” And “the issue is not that a Member of Parliament cannot be investigated or arrested. The issue is the procedure to follow to investigate or arrest a Member of Parliament.” The Speaker noted that “several Members of Parliament from both sides of the House have been investigated, arraigned before court and tried since 1993. Some Members are presently before various Courts of law or investigative bodies. “ The release noted the House had cooperated with the Police and other security agencies, in investigation of Members of the House from both sides over years, “and in all instances the Office of the Speaker has engaged and facilitated the work of the Police Service.” The Speaker said the release did not seek to suggest that Members of Parliament and Parliament were not subject to the Law. Equally, the release observed that “the Police Service is a vassal of the Constitution and Statute passed by Parliament, and formed part of the Public Service of Ghana and equally must not hold itself above the law. The Speaker said immunities and privileges of a Member of Parliament are borne out by experience from various democracies around the world, and being part of the provisions in the 1992 Constitution are for good reasons. He referred to the 1969 Constitution of Ghana and the 1968 Constitution Commission Report of Justice Edward Akufo-Addo which he said justified “the need for parliamentary immunity from arrest and service of court processes by maintaining such immunity ensured that Members of Parliament were not distracted by arrest and detention while attending Parliamentary business. “ The release reiterated the position of the Speaker that “immunities and privileges of Members of Parliament are not absolute, and that “the procedure for causing arrest of a sitting Member of Parliament or serving court processes must be in accordance with the Constitution.” On the interdiction of the body guard of the MP for Madina Constituency, the Speaker said he believed the action taken by the Police Service to “interdict the bodyguard of the Member of Parliament for Madina could affect the morale of all bodyguards of Members of Parliament and weaken the ability of the guards to provide the needed protection of Members of Parliament.” The Speaker assured Ghanaians that he he swore an oath at his election as Speaker to discharge his duties and to uphold, protect and defend conscientiously the Constitution of Ghana and would continue to do just that. The Minority in Parliament has demanded the immediate review and scrapping of taxes on petroleum products which they argue constitutes about 40% of the price build-up in the 2022 budget. According to the NDC MPs, such a move will cushion Ghanaians who have had to endure about 43% increment in prices of petroleum products this year alone. Addressing the media moments ago, minority spokesperson on mines and energy John Jinapor accused the Nana Addo administration of compounding problems of Ghanaians by increasing taxes on petroleum products. Mr Jinapor said the excuse from the government that a litre of fuel is selling at almost Ghc7.0 cedis as a result of prices on the world market is untenable. “Ladies and gentlemen, it may interest you to know that within a spate of just one-year fuel prices have risen from 4.77 cedis per litre to 6.8 cedis per litre representing a whopping 43% increment under this insensitive government. These astronomical increases has resulted in untold hardship which is threatening lives of ordinary Ghanaians. “The Minority has equally taken notice of the lame and flimsy excuse from government and its communicators that they cannot do much to cushion Ghanaians because in their own words “they do not control the world market price of crude”. We welcome you to this Press Conference by the NDC parliamentary caucus and wish to begin by expressing our gratitude to the media for your continuous support in the professional discharge of your duties. The Minority has followed with keen interest the persistent and rampant increment in fuel prices which appears to be worsening in recent times with no hope in sight. The recent astronomical increases in fuel prices at the pumps and its attendant high cost of living to the ordinary Ghanaian cannot be glossed over. Ladies and Gentlemen of the press, it will be recalled that the Akufo-Addo government during the course of the year announced a paltry 4% increase in wages for public sector workers for the 2021 financial year, by comparing this wage increment against the current inflation of about 10.6% (Bank of Ghana), one can only come to the conclusion that the ordinary worker is already worse off and therefore cannot be burdened further with such astronomical increases in fuel prices as this negatively impacts on the cost of living. In short, the income of workers are really not increasing but the steep rise in prices of essential commodities is making it so unbearable for the citizenry to cope under the economy. As a result of bad leadership under Akufo Addo and Bawumia, the level of frustration and discontent are fast spreading among the populace with increasing loss of confidence in the current administration. Members of the press gathered here, despite the announcement of a so-called 100 billion cedis “Obatampa Cares Programme” in the 2021 budget, the ordinary Ghanaian is today faced with unprecedented hardship, suffering and excruciating poverty with no hope in sight. Minority opposes SIM cards re-registration

The minority in Parliament is making a case against the re-registration of all Subscriber Identification Module (SIM) cards as directed by the Ministry of Communications and Digitalization. The exercise, which started October 1, is in two phases; linking one’s Ghana Card to a SIM card and then physically visiting an agent of a service provider by a SIM card holder for an integration process to be completed. As part of the policy directive from the Ministry, failure to register one’s SIM within a six-month period could lead to one losing their phone numbers entirely. This means that one must have a Ghana Card to be able to register a SIM card. The Minority in Parliament finds this worrying. Member of Parliament (MP) for the Ningo Prampram Constituency and member of the Communications Committee of Parliament, Sam George, said the move is not justified. “In as much as we support any attempts to sanitize the digital ecosystem, we strongly oppose any abuse of policy to unnecessarily inconvenience the citizens of Ghana. We find it most inappropriate that the policy directive issues a fiat of deactivating SIM cards that are not linked to the Ghana Card within the next six months. This we believe is a retrospective application of legislation and a tunnel visioned approach to sanitizing the industry”, he said in a press conference. He said neither the law on the registration of SIM cards nor the law on Ghana Card makes it compulsory for the two to be linked. “The current legislation that backs SIM registration in Ghana is the LI 2006 passed by Parliament in 2011. This legislation saw the registration that happened in 2012. This Legislative instrument does not mandate the linkage of the Ghana Card to activate SIM cards. The National Identification Authority Act, 2006 (Act 707) and LI 2111 which introduces the use of the Ghana Card as the principal document for registration of SIM cards and Bank Accounts amongst others cannot be applied retrospectively to SIM cards that were registered legally and legitimately under the existing Ll 2006. Section 7 of LI 2111 makes the use of the Ghana Card mandatory but does NOT make it the sole card for the purposes of registration.” He said the Passports Office may, taking a cue from this exercise, in the future demand that all passports be “revalidated because a few holders may have falsified the birth certificates or other primary documents used to acquire their passports.” The minority insists it’s not pragmatic to demand that all SIM cards be re-registered because a few were registered “fraudulently” and that “the claim that linking a SIM card to the Ghana Card would prevent fraud is flawed”. Haruna Iddrisu the Minority Leader has said the Speaker of Parliament, “in accordance with article 88 of the Constitution”, must summon Attorney General Godfred Dame to the legislature, “as the principal advisor to the government”, to explain why President Nana Akufo-Addo “must not be held in check” for “being in breach of the laws of Ghana, and also provide some evidence to prove that [the] burning of excavators is sanctioned”. Mr Iddrisu argued that the president must lead according to the laws of Ghana. “We want him to lead the lawful Republic of Ghana in accordance with his oath to uphold the Constitution and the laws of Ghana and to hold himself accountable to the laws of Ghana”, Mr Iddrisu said, adding: “No laws in Ghana, today, permit the burning of excavators”. Despite an avalanche of criticism against his style of fighting galamsey, the president insists on the burning of excavators and all other equipment used for illegal small-scale mining once seized by the Operation Halt II team. The president recently asked Ghanaians who disagree with his approach to proceed to court for redress. Speaking for the first time on the matter at a sod-cutting ceremony for the construction of the Law Village Project in Accra on Wednesday, 26 April 2021, Nana Akufo-Addo justified his approach and urged Ghanaians to support his government to put an end to galamsey. The President said: “I know there are some who believe that the ongoing exercise of ridding our water bodies and forest zones of harmful equipment and machinery is unlawful and, in some cases, harsh”. “I strongly disagree, and I would advise those who take a contrary view to go to court to vindicate their position if they so wish. That is what the rule of law is all about.” “The Ghana Law Reports of modern times are littered with cases in which my clients thought it necessary to challenge government action. On the majority of occasions, the courts upheld my contentions, in a few others, they did not. The rule of law, he said “does not recognise social status, religious persuasion, political affiliation, ethnic origins or regional adherence” but “merely the law and precedent, the ancient common law doctrine of stare decisis”. President Akufo-Addo noted that any person who, without a valid licence, conveys any equipment onto a piece of land purportedly to conduct activities for the search, reconnaissance, prospecting, exploration or mining of a mineral, commits a grievous crime against the law. He said: “Indeed, a person in possession of a valid licence but undertakes mining in water bodies or mines unlawfully, in protected forest zones also commits an illegality”. “Apart from criminal violations of Act 703, the activities of such persons desecrate our environment, pollute our water bodies, and endanger the lives of present and future generations of Ghanaians”. “They are monumental crimes which should not be condoned in any shape or form.” He continued that the presence of chanfans in water bodies is illegal, as is the unlawful use of excavators in protected forest zones. “The devastation caused by these equipment is nothing short of evil, and we should not compromise in our efforts to protect our environment, forest reserves and water bodies,” he said. Nana Akufo-Addo stressed: “I say with all the emphasis at my command that no rights can accrue to or flow from the criminal venture of galamsey. The equipment, which is being used for an illegal or criminal purpose, cannot confer on the owner or any other person any rights whatsoever.” He appealed to all Ghanaians, including the opposition, to rally behind his government in its efforts to stamp out far-reaching illegality and criminality, “rather than advocate the protection of non-existent rights of persons caught in this evil activity.” “I swore an oath on 7 January to be faithful and true to the Republic of Ghana and that is exactly what I am doing in the fight against galamsey,” he added. Minority MPs have returned a negative verdict of the state of the Nation delivered by President Akufo-Addo on Tuesday, March 9. Delivering the State of the Nation Address, President Akufo-Addo among other things said “the government will come back to engage the House on the steps it intends to take on the future of the Agyapa transaction.” The botched deal was flagged as corruption laced by former Special Prosecutor Martin Amidu. Mr Amidu resigned from the post citing interference in his corruption risk assessment of the deal by the President. The President also stated that there had been no food shortages in Ghana despite the Covid-19 pandemic. He, however, failed to touch on the country’s debt stock. But NDC MP for Asunafo South Eric Opoku accused the Nana Addo administration of borrowing over 165 billion cedis in four years with very little to show for it. The minority spokesperson on Agriculture further disclosed that the IMF has cautioned the government it’s likely to default in the Sinohydro bauxite barter agreement with the Chinese government. According to Eric Opoku, any such development will lead to the Chinese taking ownership of the said bauxite deposit at Atewa without the country realizing the benefits. Bolgatanga Central MP Isaac Adongo also stated that the President’s attempt to blame the Covid-19 Pandemic for the poor showing of the country’s economy cannot stand. According to him, the pandemic only exposed the underlying conditions of an already ailing economy due to mismanagement. Adongo argued that the country’s economy is retrogressing. However, the majority argued otherwise hailing the President’s achievements over the past four years. Reports reaching Apexnewsgh.com has it that some of the governing New Patriotic Party (NPP) Members of the 8th Parliament made another history for the first time by going to take their seats in the chamber of parliament as early as 4 am. Although the speaker of Parliament is expected to announce during proceedings for the day at 10 am who is the Majority and who is the Minority. However, some credible news portals report that by 8:30 am, there were over 70 Members of Parliament from the NPP seated in the Chamber in white attires. It appears the decision of these NPP members of Parliaments was to avoid their 7th December experience of not having the opportunity to sit on the right side of the Speaker, which is appropriately reserved for the Majority in Parliament. It was not as simple as expected at the Electoral Commission Headquarters in Accra when Minority members in parliament led by Hon. Haruna Iddrissu beseeched the EC’s Headquarters to present their petition.   Some of the MPs were seen dressed in a mourning black attire with their faces frowned which indicates how peeved they were, following the recent happenings in the country especially after the declaration result of the December 2020 general elections.  In an event which the Minority described as a peaceful walk to the Electoral Commission Headquarters to enable them to submit their petition, some of them were captured struggling themselves through the barricade as they were been pushed by the police but few of them later passed through the barricade and was able to penetrate.   However, some MPs described the situation as an unfortunate incident as they expressed dissatisfaction. according to them, they were surprised that police personnel was seriously preventing them not to submit their petition. During a protest in Tamale First Vice Chairman of the NDC, Chief Sofo Awudu Azorka said the NDC intends swearing in John Dramani Mahama as President on January 7.  Adding that the NDC believes that John Dramani Mahama is the legitimate President of Ghana and no human can change that.
