Lawyer sues CJ for preventing to grant him audience

A private legal practitioner, Kwame Aning Fosu-Gyeabour, has taken legal action against the Chief Justice, the General Legal Council (GLC), and the Judicial Secretary for issuing a circular to all courts not to grant him audience.

The suit, filed on February 22, 2024, alleges that the defendants acted unlawfully in restricting his access to the courts.

In the lawsuit, Fosu-Gyeabour seeks a declaration that the circular issued by the defendants is false, unlawful, illegal, and unconstitutional. He is also requesting an order to set aside the circular and a perpetual injunction to prevent the defendants from interfering with his practice as a lawyer without due process.

The circular, sent on February 16 by the GLC through the Judicial Secretary, stated that Fosu-Gyeabour’s license had not been renewed for the year 2024 and instructed all courts not to grant him audience. The circular also mentioned that any orders issued on his applications would be void until further notice from the GLC.

In addition to seeking general damages and legal fees, Fosu-Gyeabour is asking for any other reliefs that may be just in the case. This legal action highlights the dispute between the private legal practitioner and the judicial authorities over his right to practice law.
