A spokesperson for the petitioner, John Dramani Mahama in the ongoing Election Petition case has urged the Chairperson of the Electoral Commission (EC), Jean Mensa to avail herself and mount the witness box for cross-examination. Speaking to the press after today’s court hearing, Dr Dominic Ayine indicated that a truthful testimony under oath will set her free and will be in honour of the God she serves. “Jean Mensa should voluntarily take the box, tell the truth and that truth shall set her free as the Returning Officer of this elections. There is no better way to glorify God than to tell the truth, the truth is very important, if you want to glorify God you take an oath and you tell the truth. Jean Mensa should take the box, tell the truth and the truth shall set her free – Dominic Ayine Quoting the Good Book to buttress his point, Dr Ayine noted that “Christ himself said it, in the gospel of John 8:32 that you shall know the truth and the truth shall set you free.” This comment follows a decision by counsels for the 1st and 2nd Respondents not to call forth any witnesses to testify. Following that, Mr Mahama filed a new application to reopen his case so he can subpoena Jean Mensa to testify after she refused to mount the witness box. However, the Supreme Court during its hearing on Thursday, February 11 ruled that it cannot compel Jean Mensa to testify against her will. Arguing his case in court for a reopening of Mahama’s case, Monday, the lead counsel for the Petitioner, Tsastu Tsikata told the apex court that if the Electoral Commission Chair, Jean Mensa testifies to the truth, she will honour the God that she serves. He said that Jean Mensa is a witness “who gave glory to God for what she was doing” and added that she should assume the witness box in honour of the God that she gave glory to in making a “purported declaration”. “My Lord, the statement I am making is that it would honour that God if she would come forward as a witness of truth,” he added. Both the EC and Akufo-Addo’s legal team are of the opinion that the petitioner has lost his footing in the case, hence their pursuit of Jean Mensa as a witness to revive their case. Dominic Ayine, however, refuted that assertion, stating that Mahama’s legal team wants Jean Mensa to testify in order to account for the conflicting numbers she declared. “If you look at C.I. 99 it does not provide against compelling a witness to come and testify. So the subpoena that we are seeking to issue is in pursuit of the truth, we want Ghanaians to know how 51.589 became 50.08 something. “Ghanaians have the constitutional right to know and so for you to say that just by reason only of the fact that we are seeking to get her to come and testify, we are doing so because our case is empty and there is no evidence to prove it is totally disingenuous,” he stressed. The Supreme Court on Wednesday rejected the application to inspect six (6) documents of the Electoral Commission(EC) an application filed by the 2020 presidential candidate for the National Democratic Congress (NDC) John Dramani Mahama. The legal team of John Mahama is asking for six documents including the originals of the constituency presidential election result collation forms (form 9) for all constituencies, the originals of all constituency presidential election results summary sheet (form 10) and the originals of the regional presidential election collation forms (form 11) for all regions. They are also asking for the originals of the regional presidential election results summary sheets (form 12) for all regions and the original of the declaration of the presidential results form (form 13) as well as the records of the alleged update to the purported declaration of presidential election results on 9th December 2020, of the results of four (4) constituencies in the Greater Accra Region. In reaction to this, a leading member of the New Patriotic Party (NPP), Gabby Otchere Darko queried: “what really is the issue” “The so-called Form 13 (Declaration of Presidential Results Form) is already filed as Exhibit 4 and attached to witness statement of Jean Mensa. According to Mr. Oppong Nkrumah who was addressing the media after the court hearing, he very optimistic that the issue of whether the EC has the right to instruct the representatives of the petitioner was made clear in Supreme Court today. “When you read the witness statement, the witness statement says, ‘we were asked’, check the definition of ‘asked’. Now in the witnessed box and under oath, he seeks to amend that ‘they were instructed’ and that is why see lawyer Akoto Ampaw did not take too much time in his cross-examination. He asked one key question, he said, I put it to you that you know that you cannot be instructed by the chair of the first respondent and he said replied yes, we cannot be instructed by the chair of the first respondent”. NPP MP involved in serious accident, 8 injured [Photos]
Member of Parliament (MP) for Akyem Oda, Alexander Akwasi Acquah, has escaped death after a commercial vehicle crashed into his pickup. Eight passengers, who were in the commercial vehicle, are said to have sustained various degrees of injuries. The incident reportedly occurred on the evening of Monday when he was travelling from Koforidua to Accra. The commercial minibus is said to have veered off its lane and rammed into his Ford vehicle at the Asuoyaa Bridge. Why NDC did not present its collated figures to Supreme Court – Sammy Gyamfi reveals
Lawyer Sammy Gyamfi, a member of the National Democratic communication team in the ongoing election petition has stated that the case presented to the Supreme Court by his party’s flagbearer in the 2020 presidential election, does not require the presentation of their collated results for their case to be proven. John Dramani Mahama who is the petitioner in the case is asking the supreme court to cause a rerun of the 2020 presidential election between himself and President Nana Addo Dankwa Akufo-Addo (second respondent) on the basis that the Electoral Commissioner, Madam Jean Mensah (Second respondent) per the figures which she declared as the result had none of the 12 candidates obtaining more than 50% of the total valid votes as required by the constitution. In a back-and-forth banter with members of the bench in the ongoing petition, the General Secretary of the NDC, Johnson Asiedu Nketia who is a witness for the petitioner during cross examination said he was unable to furnish the court with votes obtained by his party’s candidate in the election based on their collated results. His answer to the supreme court judges has many critics highlighting it as a moment of damage to the NDC’s case. However, Sammy Gyamfi who doubles as the party’s National Communications Director in a Facebook post has explained why the party’s collated results, is not significant in arguing their case. Drawing on the similarities and differences between the NDCs 2020 petition and New Patriotic Party’s 2012 petition, Sammy Gyamfi points that Nana Addo Dankwa Akufo-Addo in 2012 did not present his own collated results to support his case despite asking the court to annul portions of the total valid votes and declare him winner of the presidential election based on the resultant outcome. “For the records, candidate Akufo-Addo and Dr. Bawumia did not present their own collated figures or results to the Supreme Court in the 2012/2013 election petition. I dare anybody who disputes this fact to point me to any paragraph in the 2012 election Petition where the petitioners presented their own collated figures to the Supreme Court to show that they won the 2012 presidential election. In that case, the petitioners presented the EC’s own declared figures to the court and asked the court to annul about 4 million votes on grounds that those votes had been affected by alleged legal infractions and irregularities. The petitioners then proceeded to deduct those votes from the results/figures declared by the EC and sought a declaration from the court that candidate Akufo-Addo won the 2012 Presidential election on the basis of the resultant outcome, i.e if those votes were actually annulled. The Petitioners did not present their own collated figures to the Supreme Court to show that they won that election,” he explained. Again, he averred that “unlike the Petitioners in the 2012/2013 case (Akufo-Addo & Bawumia), the petitioner in the present case, John Mahama is not asking the Supreme Court to annul votes and declare him President-elect on the basis of the resultant outcome. He is simply telling the court that per the figures contained in the declaration of the Chairperson of the EC and Returning Officer of the 2020 Presidential elections, Mr. Jean Adukwei Mensah, none of the 12 candidates in the 2020 Presidential elections attained more than 50% of the total valid votes cast as required by article 63(3) of the 1992 constitution, hence the declaration of candidate Akufo-Addo as President-elect is unconstitutional.” On this basis, NDC National Communicator says “John Mahama doesn’t need his own collated figures to illustrate or prove his claim that Jean Mensah’s declaration is unconstitutional and invalid. Rather, he needs the figures contained in the declaration of Jean Mensah to illustrate and prove his case, which is precisely what he is doing in court.” He emphasised that the collated figures of the NDC has nothing to with the petition; adding that the petition is only challenging the constitutionality and validity of the 2020 election Presidential results declared by madam Jean Mensah based on the figures contained in her declaration. Former Deputy General Secretary of the National Democratic Congress, Koku Anyidoho has broken his silence over his GH¢10 million defamatory suit filed against an aide to former President John Dramani Mahama. Mr Anyidoho on Thursday, January 28, 2021 filed a defamatory suit at the Tema High Court against Dzifa Gunu, for publishing a defamatory article about him on January 16, 2021 in a Facebook post. Speaking on the suit for the first time, Mr Anyidoho in an interview with Okay FM monitored by GhanaWeb said, his decision to pursue the defendant was borne out of persistent attacks on him, one of which he thought was ridiculous and uncalled for. These were accusations to the effect that, he was involved in the death of his 8-year-old daughter. “On November 17, I sadly lost my 8-year-old daughter, I’ve not finished mourning her and in my brief moment of consolation, someone goes to write that I killed my own daughter for money rituals. Can you imagine?” he questioned. According to him, his quest for legal redress is to clear his name in the sight of his remaining children who will be compelled to think their own father killed their sister for money as alleged by Dzifa Gunu. Asked why as a member of the NDC, he did not use internal party structures to address the issue, Mr Anyidoho said the disrespect and deliberate attempt to taint his image by the aide to the former President has become too much for him to bear. “This is not the first time, in December he wrote something about me that I didn’t mind. But consistently he has attacked my personality. I don’t know him from anywhere. I’ve seen him once or twice somewhere but he is not my friend, we don’t hail from the same town, he has not been to my house before and neither have I. But he has decided that he will continuously attack the personality of Koku Anyidoho,” he said. The suit by Koku Anyidoho also states that the plaintiff, in the article he published on social media, alleged that he had made several attempts on the life of former President John Mahama which was untrue. He avers that the defendant, by his careless and reckless claims, has lowered his reputation in the eyes of the public which has resulted in him suffering “great distress, embarrassment and damage to his reputation”. In addition to the damages, Koku Anyidoho has asked the High Court to injunct the defendant from publishing further defamatory materials about him, he is also asking for a retraction and apology of the publication and an order for the defendant to pull down the publication from Facebook as well as other social media platforms and news portals that published it. The former Upper East Regional Minister and a well distinguish Bongo personality Profession Avea Nsoh has said, he is optimistic about the fast increase development in the Bongo Constituency as he believes Peter Ayinbisa performed well in the last 4 years because he had the resources. Prof. Avea who was speaking in an exclusive interview with Apexnewsgh.com said, Bongo Constituency has gone far in terms of development. Even though he expressed worry about the kind of politics played, he believes sometimes they got it wrong by taking simple issues too far which atimes denied them the opportunity for more development in the constituency. He eulogized the NPP and the development they brought on board within the last 4 years under the leadership of Peter Ayinbisa who is currently acting as the District Chief Executive (DCE) in the constituency ranging from roads construction, covets, schools added, a number of students in secondary schools and number of students who benefited from the scholarship scheme as a good development for the people of Bongo Constituency. However, Prof. Avea believes a lot needs to be done as far as development in Bongo is concerned “I have always maintained that in development we have gone very far. We might be playing politics but sometimes we take it too far. What we forget, is that whether we ourselves or political parties that are doing something new, we don’t take counts of what happens. Take for instance what the NPP has done, some of the roads they have made, they made covets, they have been schools that have added, some students were supported to scholarship and all that, so people don’t take their time to counts in fact we are moving. Development has grown so fast. Look at our road system going to Tamale alone, I mean the long Journey, going to Navrongo and even Bongo, going to Bawku, let forget that is not very good. So, if you look at most communities now and a lot of roads that were tarred in Bolga itself. If you take Bongo, for instance, there is a lot that has been done but there is still a lot that can be done. What we should be looking at is, how many of our people now are in secondary schools? How many secondary schools now exist? How many small businesses are there? How many motors, about 5 years to 10 years do we have the number of motors and motor repairers? These are all things we have to look at if we are going to counts the developments. For me, I think Bongo has grown quite a lot and we can still move it much further by re-strategizing and leaving the criminal political activities, I think we can make a move. I think Bongo has done quite well, even in the last 4 years and I can tell you we change a lot”. He explained Meanwhile, when he asked was to rate the development brought between the National Democratic Congress and the New Patriotic Party in the constituency, this was his explanation. “If am not a frank type, I will definitely say is NDC, but I can assure you, for that one I have to be frank about it, is not because am NDC, we have been there for a long time, look at how long Agambire was there and when he came the others didn’t do very much Apikiya and the other one is possible at that time they didn’t get the resources they needed. They did their best but not much. But, Ayinbisa did that because they had a lot of resources to sort of. So, He did quite a lot and as I have said, I haven’t taken counts of that and must admit that sometimes when we come, we are not able to get time to walk around even though we read around and talk to people and all that. So, he would have lost big time and that one there is no question about it, he would have lost. If you look at the last 4 years how the PPP candidate got almost about 30,000 votes, this year he didn’t get anything. The reason was that no one likes Bawa at the time and there was open opposition known as Lai Lai faction. So, people like us just withdraw, we didn’t attend any of the campaigns and stuff like that. They wanted someone to give it to and they did that because the NPP person wasn’t very well known, he wasn’t proactive and he has not been moved around and most importantly, he didn’t have the resources because he wasn’t in power so it was difficult. So, they saw this young man who was very smart and I think they could give their vote to the PPP man. So, if for instance that time Ayinbisa was the candidate because he had the resource, he got a lot of us, we have been friends for some time, but not friends to eat and drink every day, but we have been friends. So, people felt now the PPP candidate is not strong enough and he doesn’t have a base, and NPP have a number of votes already, so they felt they would have just voted Bawa out, so that was the idea. So that he can learn a lesson and others can learn”. “Bawa is a nice person but, is just that he starts from a wrong path and he will not take his time and listen, look at the system and the background that is how the problem was. So, that is why people wanted to teach him a lesson and also, we wanted to just sit and watch.
