Ghana’s Minerals Commission has withdrawn Chinese-owned Shaanxi Mining (Ghana) Ltd’s mine support service registration and ordered it to vacate the mining sites of its local business partners in the Upper East Region, Yenyeya Mining Group and Pubortaaba Mining Group, with immediate effect. Although the notice was formally issued last month, the letter― dated 17th August, 2021― was intercepted by Starr News only on Wednesday. Whilst the directive, which appears to have been kept under wraps until now, may prove to be the latest thorn in Shaanxi’s flesh, fresh reactions from a few who have also sighted the letter strongly suggest that there is even more action ahead against a company that has dominated headlines in the West African state for mining-related deaths and injuries for years. Some opinion leaders, who say they want their names mentioned only when the promised action begins in front of media cameras, say they are going to mobilise people in Talensi, the district where the Chinese have been operating since 2008, to force the company out from the 50-acre piece of land if it delays further than allowed in checking out as ordered by the Commission. They did not mention when they would do it but they said it would not be done without notifying police. “We refer to your company’s registration as a mine support service with the Minerals Commission. We note that your company has been providing contract mining services to Yenyeya Mining Group [now known as Yenyeya Mining Company] and Pubortaaba Mining Group which are located at Gbane in the Talensi District of the Upper East Region since 2009. In the period after 2012, the Minerals Commission continued to renew your company’s registration because of Regulation 2(3) of the Minerals and Mining (Support Services) Regulations, 2012 (L.I. 2174). “Unfortunately, the Commission cannot continue to renew your company’s registration because of the coming into force of the Minerals and Mining (Local Content and Local Participation) Regulations, 2020 (L.I. 2431) which has reserved contract mining services for small-scale mining operations for Ghanaians. We are therefore by this letter withdrawing your registration as a mine support service company with effect from the date of this letter. You are advised to arrange to demobilise from the sites of the two small-scale mining licence holders with immediate effect,” says the one-page letter, signed by the Commission’s Acting Chief Executive Officer (CEO), Martin Kwaku Ayisi. Shaanxi changes termination date after receiving quit order The letter dispatched to Shaanxi made it clear that the company’s registration as a mine support service provider was being withdrawn with effect from the very day the letter was written― 17th August, 2021. The letter also directed the company to “demobilise from the sites…with immediate effect”. But ten days later, Shaanxi wrote to Yenyeya, informing its partner about the Commission’s directive, but giving a termination date different from what the Commission had stipulated. The letter the Minerals Commission wrote to Shaanxi. “I have been directed by the Chief Executive Officer (CEO) of the Shaanxi Mining (Ghana) Limited to inform you in relation to the aforesaid subject matter [Withdrawal of Registration as a Mine Support Service Company]. Per the content of the letter we shall attach to this letter, by operation of law, our Mine Support Service to you which culminated in a contract dated 24th September, 2008, between the aforesaid company and your group, has been terminated. “By reason of that, we wish to inform you that, by 1st September, 2021, we shall cease operation as providing Mine Support Service. The content of this letter does not however terminate any rights and obligations that existed between our company and your good self prior to the termination of the Mine Support Service. On behalf of the CEO, I thank you for the opportunity and cooperation that you accorded us during these years,” said the company’s Managing Director, Ryan Lee, in the letter, dated 27th August, 2021. At present, Shaanxi and Yenyeya are locked in a serious legal battle at the High Court One in Bolgatanga, the Upper East regional capital. In 2008, the wealthy Chinese firm arrived in the district at Yenyeya’s invitation to render mine support service to its twin hosts, Yenyeya and Pubortaaba. Yenyeya and its foreign partner had worked closely since then until Shaanxi, after reportedly taking root in Ghana’s mining industry through the aid of some “powerful figures” in the country, announced a plan recently to go solo into a large-scale mining business. Shaanxi’s letter to Yenyeya Shaanxi intends to do the new business under a new name― “Earl International Group (GH) Gold Mining Limited”. And it is reported that the clash between the two partners erupted after Yenyeya’s Ghanaian-born Managing Director (MD), Charles Taleog Ndanbon, learned that the Chinese (his guests or ‘tenants’) had planned to acquire licence and permit for the sought-after large-scale mining business, to end their partnership with him and to take over his concession and some nearby concessions. So, the Yenyeya boss headed to court. And in his Statement of Claim, he wants the court to declare that Shaanxi had breached the agreement it had with Yenyeya. He also wants the court to call for the appointment of “an independent professional auditor” to audit the “mining operations and other related activities” carried out from 2008 to date inside the Yenyeya Mining Company’s concession. And he wants the court to place “a perpetual injunction” stopping “Earl International Group (GH) Gold Mining Limited from doing “illegal mining and related activities” in his concession and from entering the concession until the case is over, among other reliefs. Months ago, the lawyers for the Chinese company told Justice Charles Wilson Adjei’s High Court One that they wanted the matter settled outside the courtroom. The out-of-court settlement process, being facilitated by the Upper East Regional Minister, Stephen Yakubu, saw the representatives of the Chinese company absent in the first meeting, according to Yenyeya’s Public Relations Officer, Jarvis Avoka, in a press statement. Tension in Talensi as 11 Tindaama clash with Tongraan over Chinese miners
Tension is rising in Talensi, a mineral-rich district in the Upper East Region, as traditional landowners (Tindaama) and the Paramount Chief of the area, Tongraan Kugbilsong Nanlebegtang, are seriously engaged in an unusual clash that has also generated disquiet among security watchers. The ‘supremacy war’ is grounded in a recent controversial move by the Earl International Group (GH) Limited—a new name said to have been adopted by the familiar Chinese-owned Shaanxi Mining Ghana Limited— to “unduly” take over more land in the deprived district for large-scale mining purposes. That move, strongly opposed by the natives of the area who say the action was being made without due consultation with the appropriate stakeholders, drew widespread anger with some traditional landowners also petitioning the Environmental Protection Agency (EPA) to pay no attention to an application letter written by the Earl International Group (GH) Limited to the EPA for permit. Whilst the Tindaama were waiting for a reply to their petition from the end point, the Tongraan wrote to the EPA, urging the agency to ignore the petitioners (the Tindaama). The letter is dated 11th September, 2020, and captioned “Re: Objection to Refrain Earl International Group Ghana (GH) Limited from Mining at the Gbane Gold Project.” And it reads: “Our attention has been drawn to the [above-mentioned] issue said to have been raised by the Tindongo, Duusi and Sawalig Tindamas requesting your outfit [to] not approve of the permit application submitted to your office by Shanxi/ Earl International Mining Group (GH) Ltd. I wish to state that you ignore such a request. The Talensi [Traditional] Council and the paramountcy which is made up of all the traditional rulers (both Chiefs and Tindamas) is the supreme body headed by the Tongraana and it is the supervising authority in the Talensi Traditional Area within the Talensi District. Any matters relating to the mining/land should be brought before the Talensi Council without which remains invalid. “It must be noted that Stool Land Administration in Talensi Traditional [Area] conforms to the Stool Lands Administrations Act 1994, and all issues related to such matters have to be handled and dealt with according to the [laid-down] procedures. The Tongraana has supervisory, jurisdictional and territorial control of the people, land, rivers, etc. in all of ‘Talenteng’ (Talensi Traditional Area). This should be well noted so as not to allow people who are self-seekers and [confusionists] to create any conflict in the area. It should be noted that the paramountcy has for some time tolerated activities of some persons [who] are inciting people in the area to create confusion in the area. The paramountcy advises that such persons should desist from such acts in their own interest.” Your letter full of inaccuracies, jokes and borne out of greed— Tindaama tell Tongraan in rebuttal Eleven traditional landowners wrote back to the EPA, saying the content of the Tongraan’s counter letter was driven by “greed, egoism and parochial interest”. “When we received the letter, the content appeared as though it was a joke considering the number of grammatical errors and the letting out of stream of thoughtless invectives against the Tindaama and the people of such communities as self-seeking and confusionists who only seek to create confusion in the area. Has Tongraan met with the Tindaama he is referring to concerning Earl International Group (GH) Gold Limited’s intention to do large-scale mining in Talenteng? If he has met with them concerning this issue, what decision was taken about the exploration activities on our lands and when was that decision taken? Tongraan should remember that in May, 2018, the Tindaama in a letter stated clearly and unequivocally that they were not ready to co-sign any lease with him or any of his sub-chiefs. Attached is the letter for reference. Why should Tongraan be responding to a letter that was addressed to a state institution responsible and capable of addressing our concerns? “The Tongraan, in an attempt to consolidate his position on the matter, churned out a number of inaccuracies on land ownership and administration in his letter to the EPA. What is his locus in attempting to direct the EPA to ignore our concerns? It must be pointed to the Tongraan that there is no such thing like a supervisory body that controls and supervises lands belonging to individuals or clans when it comes to mining activities. His request should rather be ignored. It only exists in Tongraan’s mind purely borne out of his greed, egoism and parochial interest. Tongraan must know that there is something called Social Licence to Operate (SLO) when it comes to mining. The Social Licence to Operate, though an informal contract with the people, [is] yet very critical for success of any mining activity in a community,” the traditional landowners stated in their reaction. Your continued tyranny, distortions of historical facts unacceptable— Tindaama to Tongraan The Tindaama also rubbished the Tongraan’s reference to the Stool Lands Administration Act 1994. They said his claims stood on “mosquito legs” because “he should know that in the Upper East Region, and Talensi to be precise, lands belong to individuals, families and clans with the Tindaama having the oversight responsibility of such lands and not chiefs”. They made it clear that they would bow under “no amount of inferior tactics” on their demands “to be engaged with, treated fairly and adequately compensated for the use of our lands by Earl International Group (GH) Limited”. “We are determined to galvanise the efforts of the generality of our people to resist Tongraan and his new found friends (Earl International Group (GH) Gold Limited) in respect of exploration activities on our lands without properly engaging us. The current Tongraan, through his actions and behaviour, seems to suggest that we are in a master-servant relationship with him. His continued tyranny, distortions of historical facts, lack of respect for the people of Talensi is unacceptable. He must be told in plain language that no court in Ghana will endorse his attempt to dispossess landowners of their lands

Parliamentary Candidate for the governing New Patriotic Party (NPP) Thomas Daunab Wuni has questioned the achievements of the opposition National Democratic Congress (NDC) in the Talensi Constituency since their 19 years in power, especially with the mandate given to them by the people of Talensi constituency. He said the only community center the Constituency is proud of, which was later converted to offices was built under the first NPP government in the early 70s. “What is it that we have benefited, what do we have to show? Go round you will find people building state of the art for their communities; can we point at one in Bolga here? Let alone to come to the Talensi to point at one?”. He questioned “We have a community center that was built in the 70s by the first NPP government; I am not talking about Kufuor’s government. That is the only community center you can look around that we have converted into offices. We have never thought of a community center in our place”. He stressed Talking about road infrastructure, the Parliamentary Candidate described the road infrastructure in Talensi Constituency as very poor road in a solid-state, as he admonished the NDC in Talensi not to talk about road infrastructure, because for all their years in power they did nothing to bring the Talensi road in good shape. “Our road infrastructure is very poor in a solid-state and I hear the NDC followers making the loudest noise about road infrastructure now, calling on the DCE to go and fix the road and the young man has just been in office for just 3 and half years. However, he also believes the Talensi Member of Parliament Mr. Benson Tongo Baba has not done anything better in terms of assisting Talensi Children with some learning competitions as a way of preparing them ahead of the BECE exams. “In 2015, I identify something, because I followed the performance of statistics of BECE related to my district; I studied 3 years of it and noticed there was a serious problem. So I went around and asked some teachers to tell me why we are having poor performance and they were genuine concerns. The beginning was not too good and they offload them to JHS and turned them out. They sighted textbooks as one of their problems and we have about 48 JHS in the Talensi District and I bought a set of a textbook to every JHS in the District and I threw a challenge that, if by the end of the BECE exam I got any student getting one in mathematics, I was going to be personally responsible for paying and taking care of that student till he or she finishes whatever programme they want to do and till now, no one has claimed that award from me”. “So I would have thought that the seating MP, instead of concentrating on providing mathematical set on examination day, he would have taken it up to deal with the base. I even doubt if some of the students know how to answer the question before they enter”. Mr. Duanab said giving BECE candidates a mathematical set without teaching them how to use it, is a bad idea. “Is a bad idea, because the children have not been trained to use a mathematical set. If I had my way, I will go and get all the Talensi marking scheme and their mathematics papers to see how many of them gets construction in the examination hall, with that we should be able to tell if the maths set is of use to them. And thought the MP would have arranged a stakeholder dialogue to share ideas and to see the way forward and that is lacking seriously”. You are an MP, “YES’ you are to sit in parliament and make laws and in making laws, you should be thinking about your constituents, those you represent to solve their primary problems. In this part of the world, a Member of Parliament is not supposed to go and sit in parliament and everyday you say yeaaaaaaah yeah, that is not what is required of a parliamentarian.
