Accra High Court Orders Return of Seized Funds in Cecilia Dapaah Case

In the case involving Cecilia Daapah,  the Accra High Court has instructed the Office of the Special Prosecutor (OSP) to return the funds that were previously seized from Cecilia Dapaah within 72 hours. This decision came after the OSP requested confirmation of freezing and seizure orders relating to the bank accounts and assets of the former Minister for Water Resources and Sanitation. The Special Prosecutor, Mr. Kissi Agyebeng, announced in a press conference that the case would now be handled by the Economic and Organised Crime Office (EOCO). The court order mandates the OSP to return the cash sums and unfreeze the accounts within the given timeframe. Mr. Agyebeng cited suspicions of money laundering uncovered during the investigation as the reason for transferring the case to EOCO. He also emphasized the ongoing collaboration between EOCO and the FBI in dealing with this matter. To provide some background, Cecilia Dapaah and her husband, Daniel Osei Kuffour, found themselves facing legal issues when their housemates were charged with stealing valuables and cash worth millions from their residence in Accra. The alleged thefts took place between July and October 2022, resulting in charges of conspiracy to commit a crime and stealing against several individuals, including house helpers. Various items were reported stolen, including clothes, handbags, perfumes, jewelry, Kente cloth, and men’s suits. One of the house helps, Sarah Agyei, was granted bail, while the others were remanded into custody. The theft case came to light in June 2023 when the complainants noticed the missing cash and personal effects, prompting an investigation. It was revealed that the stolen money had been used to acquire properties and expensive items, leading to further scrutiny. The Special Prosecutor initiated an investigation to determine the source of the money and address the allegations against Cecilia Dapaah. The recent court order directing the return of seized funds signifies a shift in the case’s handling from OSP to EOCO. OSP removed five bank accounts linked to Cecilia Dapaah

The Special Prosecutor has removed five bank accounts linked to former sanitation minister Cecilia Dapaah from its list of assets connected to corruption. The investigation into suspected corruption and related offenses involving Ms. Dapaah began in July 2023, following the theft of significant amounts of money and valuable items from her private property in Abelemkpe, Accra. To aid the investigation, the special prosecutor took several actions, including issuing a freezing order on Ms. Dapaah’s bank accounts and other financial assets. In an announcement on Monday, October 16, 2023, Special Prosecutor Kissi Agyebeng stated that the ongoing investigation had cleared suspicion from five bank accounts belonging to Ms. Dapaah, thereby removing them from the tainted property list. Furthermore, the special prosecutor declared the revocation of the freezing order specifically applied to the five eliminated bank accounts associated with Ms. Dapaah. Cecilia Daapah hot in court after Martin Kpebu heavy tackle

Former Sanitation Minister Cecilia Dapaah expressed her dissatisfaction with private legal practitioner Martin Kpebu’s comments regarding the ongoing investigations against her by the Office of the Special Prosecutor (OSP). Dapaah accused Kpebu of providing unfair commentary on the matter. Kpebu, known for his outspoken nature, has consistently supported the OSP’s decision to investigate Dapaah, seize money found in her home, and freeze her bank accounts on suspicion of being tainted properties. These confrontations took place after the High Court had heard arguments regarding the abridgement of time for the hearing of the confirmation of the freezing and seizure orders. Martin Kpebu was present in court to represent his client in a separate case in Financial Court 2, where proceedings related to the Cecilia Dapaah case were being held. Kpebu defended his commentary by stating that it was solely based on the publicly available facts of the case. Dapaah’s Case: Former house help applies for bail, boyfriend’s bail request ….

The lawyers representing Patience Botwe, an 18-year-old individual accused of masterminding a theft case involving $1 million and 300,000 euros at the former minister for Sanitation, Madam Cecilia Dapaah’s residence, have submitted a formal bail application at the Circuit Court in Accra. However, the Prosecution has opposed the bail application and has served it to Botwe’s lawyers this morning. Nana Addo Asrifi, the lead counsel for Patience Botwe, requested a brief adjournment to allow him to respond to the Prosecution’s affidavit opposing the bail application. On Tuesday, September 5, 2023, in the Circuit Court presided over by Her Honour Afia Owusuaa Appiah, the bail application filed on behalf of Benjamin Sowah, the boyfriend of Patience Botwe, was rejected. The court decided that due to Sowah’s involvement in the alleged theft case and the circumstances surrounding his arrest in Tamale, granting him bail at this stage would not be appropriate. However, Yahaya Sumaila, the seventh accused person and an excavator operator, had his bail application approved by the court. The prosecution, led by Akosua Agyaponmaa Agyemang, Assistant State Attorney, did not object to the bail request. Sumaila was granted bail in the amount of GHc300,000, with two sureties who must be resident within the jurisdiction and need to be justified. Additionally, he is required to deposit his passport at the court registry and report to the police every forth night. Extension of Investigation Time The Assistant State Attorney has requested a two-week adjournment, stating that the investigators have informed their office about the need for additional time to conclude their investigations. She explained that the delay in concluding the investigations is due to the directions given to the investigators by the Attorney General’s office regarding the case docket. DSP Emmanuel Nyamekye, the police prosecutor, added that the investigators are currently in Kumasi conducting further investigation. In response, the Court has instructed the prosecution to expedite their actions in order to ensure the trial can begin. Additionally, the Court has directed the Prosecution to file their disclosures before the next court date, although the lawyers involved in the case have requested that the disclosures be filed prior to the next court sitting. However, Patience Botwe, an 18-year-old hairdresser, Benjamin Sowah, a 29-year-old plumber, Malik Dauda, a 34-year-old unemployed individual, and Yahaya Sumaila, an excavator operator, have met their bail conditions and are no longer in custody. They will be able to resume their normal activities until the next court hearing on September 19, 2023. Unfortunately, Job Pomary, a mechanic, Sarah Agyei, an unemployed individual, and Christina Achab, a trader, who are all lactating mothers, remain in lawful custody as they have not been able to meet their bail conditions. All seven individuals have been accused of 14 counts, but their pleas have not yet been taken as investigations are still ongoing.
